from my experience, a simple phone call to them can answer your question. For the most part, the tenant has 'more' rights than the landlord, and you should know the law and act accordingly.

Yes, I've read the book, and as I said, the law in somewhat vague. If you read my other posts, you can see that I did find and post further information.

I have a question to add....my landlord wants to show my apartment on a saturday morning (10 TO 12). According to what I've read so far, that within the law. But he refuses to do a walkthrough on a sunday because he says his normal business hours are monday to friday, 10am to 4pm. It doesn't seem fair that he can show my apartment at a time that is not during his normal business hours, but refuses to do a walkthrough.

Here's a simple solution: "Trash" the apartment.

I don't mean to do any real damage, but just leave non-food garbage and stuff laying all over the place.

Make it easy to clean up, and make sure it won't attract bugs (for instance: throw your laundry all over the place, buy some old porno mags and leave the laying around everywhere and--lightly--tape the centerfolds to the wallls.) Be creative! You can make your apartment a truly awful-looking place that no one in their right mind would rent with a minimum of effort.

The first showing while you're still a tenant will probably be the last.

This is only a half-serious suggestion. I wouldn't recommend it unless your landlord is a real jerk.

Honestly, I think that a mid-day Saturday showing is not unreasonable. That's when most prospective renters have time to look at apartments. I can understand your annoyance at being bothered, though.

Default Tenats rights

Can anyone help. I moved into a shared house renting a room, i gave first and last months rent when i arrived.

In the second month i asked the landlord whether he was open to a deal where i paid him six months rent up front as long as he gave me a discount in rent. A price was agreed and i gave him six months rent up front.

In the third month of staying in the premises, i noticed as a live in landlord he started drinking heavily, letting his pit bull defecate in the house , having impromtu drinking sessions with his friends and constructing rooms whilst tenants are in the house and a list of other upsetting predicaments.

I want now to leave and have told him, he has become very aloof and told me i am not entitled to any rebate as we did a deal by giving him six months rent and that is that.

Can anyone advise me as to what i can /should do.

I am a student and need my peace as he stated that is what he wanted in his tenants, i feel lied to and now am in a predicament as he has rent up to Jan 09

Given the arrangements you made I would think you entered into a valid six month contract which you cannot get out of unless he breaks some portion of the agreement. In my view, drinking and doing the other things you mention do not void the contract under the terms you describe.

It appears you made a good move in getting a discount on the rent but failed to enter terms of how and why you could get out of the contract.

Actually you can sue him for failingto provide a safe place and a habitable place to live. You must have proof take pictures of the dog defectation. Call the police when he is having drinking parties and get a report. Then move. You can sue for the unused rent and moving expenses (as punitive damages). Good Luck. You would also be better off starting a new thread.

we got a 24 hour notice to enter this after noon at 1:30 or so. The LL hand wrote the notice on a piece of paper, saying they he would be here at 2:00 pm tomorrow for an inspection and appraisal. Were still living here

It's sounds like he's selling the place..........that's legal.
