I wrote this once before, but for the people who didn't read it....

A new scam is out there!

Some potential tenants claim they have been evicted due to the foreclosure of their LL. I had one writing down the name and address of the property owner of the property they "claimed" to have lived and was foreclosed on...they were evicted due to the foreclosure.

When I checked the public records I noticed the eviction...$ 8,000.- judgment!

They claimed the previous foreclosed owner was nowhere to be found to tell me what a great tenants they were!

Unfortunalety for the potential tenants was that the eviction notice can be read online and the address didn't match. It came to an apartment complex and I went there in person with the signed paper to approve me doing a background check. Ther I learned the tenants didn't pay rent, trashed the apartment, kept a dog which wasn't allowed and who did everything inside and outside of the apartment! they also lived there with close to 10 people but only 4 were on the application.

I confronted them with the info after they wanted an explanation from me why they were denied and kept giving me sob stories and asking me to please rent to them...

Thank G.. for the public records, I didn't even pay one dime other than gas to go to the apartment complex and some time, to figure their scam out!

That's a good heads up, and it just goes to show you that people will take advantage of every bad situation and screw it up for those who were really evicted under those circumstances. That "screw the next guy I'm gonna get mine" mentality

People who get evicted even if the court system works fast...they are already late on rental payments so if you add that up, nobody can say they didn't know and didn't have a chance to respond.

I'm waiting what is going to happen with one of my rentals....the family asked me last month if they could pay one week later since the husband switched jobs and had now a better paid job but the pay check came later... Btw the carpet looked awful,, all drink spills from their little child and I told them it needs to be taken care off...all things taken in cosideration I'm not going to wait more time on late rent but I will go straight to court.
I run his dr. license again and he skipped a court date for unpaid tickets and his dr. licence is revoked...so to me it will be hard for him to get to work or he is driving uninsured, which makes me mad like hell! Both work in different parts of town so he isn't going to walk....
Update...they paid the late fees yesterday!

I guess my high concession fee made it possible that at least I got more money this time, now they were late

Well done on getting the fees.
In NY, it takes 2 weeks to get hte court date, the judge will give 2 more weeks for them to be out. Then the waiting begins. When this happened to me last year, The sherrif coudlnt tell me when the eviction would happen ; so the people had the keys for at least an extra month ; oh gosh, they still have the keys (but the locks wont work).

No more sob stories. Our section 8 tenant finally paid me up to date on her part of the rent ; 4 months late. Yes, i knwo I should have evicted her. But as it is a single family home, in a hard to rent area, its better to get 90% of the rent from the county and all utilities paid, than none. And her part is $128 a month. But I tell you I do not rush when she has a problem at all. it gets fixed on my time. She knows things get fixed(eventually).

I understand your position, but what happens if the tenant isn't happy with your time frame of the repairs...will her complain be listened to and perhaps they don't care about her not paying on time....

I'm on your side though

I dont know about that one. But my mail today included a letter from the county saying they were reducing her benefit and the rent would be $500 less than they used to pay.

So now as it is such a big amount ; what are the odds that she will be on time!!

As for the repairs ; if it was a dangerous situation of course I would get right on it. But if it is a small problem ; thats a different story ; like replacing a light bulb ; she dosnt have the $$ to replace a light bulb!!

I am so glad I am renting from a landlord whos house is already paid for....shes a very good landlord...she fixes things in a timely matter...and she works with me on my rent...if im a little late or need to pay 1/2 she never charges me a late fee because I keep my word.

Landlords and tenants need to have a good relationship

I couldn't agree more. I don't want to set off any kind of a furor but I'd venture to guess that there are far more bad tenants out there than there are bad landlords while landlords always seem to get the bad rap.

A happy landlord/tenant relationship is first based on a comprehensive legally viable contractual agreement agreed to by both parties. Only secondly based on "good faith". And even "good faith" agreements outside the lease agreement should be agreed to in writing and notarized.
