Is it fair?
We have a section 8 tenant. The house is located in a central area ; central to bus etc but we have to pay extra for garbage which I pay.
Recently three times the tenant has put out an enormous amount of garbage ; one time it was two dressers, another time matress's and recently about 20 garbage bags of clothes. The garbage guy said he would take the furniture if she paid $30. She refused so the garbage sat there for weeks until each time my dh came with his trailer and dumped it all.
Today I saw her and told her that if she had anymore garbage in excess, I would have to charge her to dump it. When my dh took the matress's he actually got very sick as it was damp and must have had mold in it ; it was out in the rain!!
So do you think it is fair for us to charge ; i say yes, as it has to be taken to the dump. I know she dosnt really have it, but I dont want to make it a habit for her to do this. I already pay about $35 a month to the garbage company.

in my lease agreement i am responsible for the trash....maybe you can implement that when you renew the lease

My Rental Agreements state rent includes 1ea 32 gallon curbside container per unit, per week... tenant responsible for compliance with City and Waste Mgmt disposal regulations and additional trash disposal fees in excess of minimum service.
By City Ordinance, Owners are responsible for weekly minimum trash service per unit...

If it is her extra trash that costs extra than the normal household trash OF COURSE they need to pay for it. We have to buy stickets here @ $8 each for large items and if they are left on the curb with no tag the owner of the house gets fined. That would be grounds for eviction in my book!

In my area, the city will pick up large items twice a year if you call them. Any more than that and they charge the tenent for the pick-up.

Why in the world is a Section 8 tenant throwing out so much reusable stuff? Call the women's shelter or Salvation Army for crying out loud.
If it's in the rental agreement that she has so much space for trash then she should be held to it.

Yes, it's fair. I'd send her a certified letter stating it though, so that there's no plausible deniability on her part. I'd also keep receipts for what you've already paid for, and see if you can legally deduct it from her security deposit at the end of her lease.

Only an observation... My low income tenants generally are the ones with excess trash... I said generally. After Christmas is especially bad because of all the styrofoam and packaging materials and in a few weeks... many of the imported toys end up broken and in the trash...
A big part of the excess could be dealt with by breaking down and sorting trash...
Donating is problematic and not everything is accepted...
