I bought a rent stabilized apartment and came to know that the tenants in one apartment are all illegal immigrants and have guests who i believe are illegal immigrants. Is there any way to evict this tenant.

I would say report them to the proper authorities, as long as you are 100% sure they are illegal. If they are not here legally, they should be deported, not just evicted. However, I'm no expert... good luck.

Without a legal right to be in the US, there would be no need to go thru the eviction process.

You could put them out, they wont be taking you to court, but there may be ramifications you don't want,
move on and rent elsewhere and remain in the country.

How long it takes the INS to act, is something I have no familiarity, but who I'd contact.

How did you come across this info, Do they pay rent in cash?

Do you own the apartment, or do you just live there. In the latter case, it's none of your business.

To quote Guns n roses and the Beetles "Live and Let diee...." I mean, really. You should be happy because you're in a rent-controlled apartment. So, because you THINK that someone is an illegal immigrant, you want to call the cops on them? What if you're wrong? That's not nice. If you think they're exceeding the occupancy limit for the apartment, you can call the housing enforcement department or something, but the COPS? geez.

You have a business agreement with them, and your rights only cover that agreement. You have no right to evict on the basis of other matters beyond the scope of the contract, such as criminal background or citizenship status. The same would be true if you found out one of your tenants had been arrested--so long as it didn't occur on premises or involve residents, it is a private matter and none of your business. And tenants are allowed to have guests, legal residents or otherwise.

You could call USCIS but they cannot initiate an investigation of someone based on a nosy LL's suspicions. Because our constitution protects the rights of privacy, they have to have some kind of concrete evidence to investigate a private individual.

They are illegal they have no right to be here and you are not discriminating because they are not a protected class. As annerk said, criminals are everyone's buisiness. They next job they take may be yours!

If you are sure they are illegal and have some kind of proof, you need to make a call to INS and make sure you let them know you will record the date and time of the call, so if they do not act and the illegals do any harm/damage you will be able to reference the fact that they ignored your information. It is not a live and let live situation since they have already broken one law and may not be hesitant about breaking more.
