[quote=schoepeo;13522289]Thanks for the thoughts so far. I knew it was going to be long winded which is why I apologized first thing. The questions at the bottom are the most relevant.
Our roommate doesn't owe us money, we just don't think she should get any deposit back since her portion of the rent was deducted from the deposit. She is taking US to small claims court. I know we can't have
You are over-complicating things with pettiness. You will lose this. Stick to who dates, deposits, withdrawls, period.
Did the landlord write out a summary of charges he dinged against your deposit?
The charges against the deposit should be:
Roomie A-Rent plus the late fee since she never removed her stuff from the place nor cleaned. 1/3 of the damages incurred.
Roomie B and C-1/3 each of the damage
I would take the check back to the landlord and present him with your charges/breakdown and ask him to write out three checks. If he doesn't, then you two will take him to court and sue him. He needs to grow a pair and write it out correctly. He knows the rent wasn't paid to him and 1/3 of charges is decent.
Now I do have a question, if the deposit was $2800 with Roomie A paying $1000. Does that mean Roomie B and C paid $900 each?
It's been five years.....I'm sure they figured it out by now.
I wouldn't be so sure...what a C.F.
