I keep re-reading these hoping to find that I can get the spousal benefits (but I can't. each time I read it it's really clear that we don't qualify oh well.)

I did notice the mention of the survivor benefits and now I need a class in that I guess. For some reason (and it's probably correct too) I thought that survivor benefits are not available across the board. If I begin collecting at my FRA and husband has already reached and filed at his- and mine is more than 1/2 of his...do I get zilch upon his death ?

survivor benefits are very complex . basically you get what he got including any delayed credits if you are fra . other wise you get his full less a reduction for every year under fra you are .

If you filed at FRA, and be passes after that, then you get the larger of the two, between what he was getting or your current benefit. That’s it. And you have to have been married for 2 years.

not exactly . you have a choice as to whether to take survivor and let your own grow or your own .

while survivor may be the higher now , your own may be higher at 70 .

a popular strategy is to take survivor first then at 70 change to your own .

The two year part is not correct, if someone marries the wait to collect on a spouse for benefits is 9 months. If you are divorced, then it is a two year wait to collect on a spouse and you have to have been married to the spouse for ten years if you are divorced.

I stand corrected. Those are both correct. One year married to collect spousal benefits and only 9 months for spousal death benefits. Matt is correct as long as you are under 70. Is that also true if your birth date is after the date for thoses affected by the deeming law change?

yes , survivor was not included when they went to deeming . they left the ability to have options in place for all unlike spousal .

Social Security will automatically convert your benefit payments as soon as they are notified of your spouse's death.

Unfortunately, for those already receiving retirement benefits, you can only apply for benefits as a widow or widower if the retirement benefit you receive is less than the benefits you would receive as a survivor.

You can't report a death or file for survivor's benefits on-line, you have to do that via phone or in-person.
