I was also charged with Reckless Driving about 2 weeks before my wedding in Nov 2011 in Vienna. I just got a VA driver's license a month ago after turning my NY license, so I wasn't aware of the Reckless Driving laws in VA. I was caught doing 57mph in a 35 Zone. Anyway, the best thing you could do is get yourself an attorney. I did, and my lawyer negotiated it down to a speeding ticket and a 100 dollar fine after proving that I had a spotless record in the state of NY (a copy of a driving record is about 5 bucks). I did also have 6 points on my record, but I took to a driver's improvement course to knock 5 off those points off. Most importantly, I don't have a criminal record since the misdemeanor was thrown out which would put my job as a government contractor in jeopardy.

My daughter just got a 96 in a 70, she's 18 and heading off to college, the police officer clocked her at 86 and then paced her to 96. The thing I'm most worried about is a criminal record and jail time. It's fine with me if she has to do community service, loses her license et cetera. We have gotten a lawyer but I'm just really worried. Any thoughts? Has anyone gone to jail?

I have read a lot of posts on VA reckless driving (and got a few myself... once clocked doing 88 at 65) but never heard anybody going to jail for it. Unless she is a convicted ex-felon and have a history of a life of crime (which I am fairly assuming she does not) she is not likely to go to jail. At most she will have her license suspended for a few months and have to pay a hefty fine. Hiring a laywer was a good call. Good luck.

Okay, we're trying to get a continuance right now because she's doing an honors program abroad for a couple of weeks and the court date is in the middle of that; I'll post the results when they happen. Hopefully they're good.

And apparently now in VA anything over 90 mph is mandatory jail time - that's why I wondered if anyone had experienced that?
