Last month I gave my old apartment manager written notice of my intent to vacate my apartment before April 30. I was on a month-to-month lease and paid in full for April.

I completed my move-out by April 28. I surrendered my keys and the manager asked if I had finished moving everything out, then asked if I'd like her to send me the remainder of my deposit. I agreed and left that afternoon.

Saturday I received in the mail a three-day notice to pay rent or quit dated May 12 and the manager is asking for full rent for the month of May.

I understand this is the initial step in the eviction process and I don't want to have to go to court or incur the potential damage to my credit report, especially for an apartment I don't live in any more. I was planning to send a letter in response detailing that I gave notice and left the property before the end of the month but want to make sure I proceed correctly and don't put myself in any jeopardy.

Your advice is greatly appreciated.

If you moved out and have all the paperwork signed and dated you having nothing to worry about.

I would ask if there was some sort of confusion and see if you can get a reasonable response from there. But regardless, I would consider sending them copies (if you have them) of all the documentation submitted regarding your intent to vacate via certified mail. Probably overkill, but probably worth the time to be thorough.

Did you only give oral notice when written notice was required pursuant to the lease?

My thought as well, especially if it is a large apartment complex. Property manager confusion, most likely.

I sent a letter and it was withdrawn. It appears there was new management and my record hadn't been updated.
