UI benefits are earned through work income and are not means tested. So the answer is, "Yes."

I hear different things so I was confused. Would it be considered passive income which EDD doesn't look at?

Of course you can man! can you buy iphones, ipads, grillz on your teeth, pay for tattoos, while at the same time get free health insurance and use food stamps and WIC coupons???? hell yeah you can! it's Obamerica!!! there are the Romneys that we can always rob from! OCCUPY _____ (fill in with your favorite place) !!

You're making a fool of yourself. Unemployment insurance is not means tested because it's insurance--you pay in to it so you can get money if you lose your job and qualify. This person has a legitimate question about whether they qualify.

Technically, "you" don't pay into it - employers do. They are taxed by the state based on their payroll.

Although, if one wants to get really pedantic, at the moment we're ALL paying into it because the CA unemployment fund ran out of money and they've been borrowing money from the feds in order to pay out unemployment claims. So, in the grand scheme of things we (or more accurately, our children, grandchildren, etc.) are all paying at the moment - but normally, it's a tax on employers.

Generally, yes. The exception is if you're a real estate professional who has been making a significant amount of money and dedicating a lot of time to managing properties. Say you've got a dozen vacation rentals and actively manage them... they may not consider that passive income. It would be a good idea to consult an attorney if that'st he case. But for your average investor who owns a few rental properties, even if they are managing them, absolutely.
