I was served a 3 day notice to buy the house or move out. They served me on a Tue. and they are being "kind" and giving me until Mon. 8 am to be out. There is no way I will be out by then. My new house will be avail 8/1/08. My question is if my landlord shows up on Monday demanding I leave what do I do? Do I call the police? What if she stays in front of my house parked in the street? I am really freaking out. Please help!

Why did you get the notice? Did you fail to pay the rent, or do some egregious damage to the unit?

A three day notice allows the landlord to initiate an unlawful detainer action. The unlawful detainer, if successful, allows the sheriff to show up and forcefully remove you and your possessions from the property.

I've never heard of a three day notice to BUY a house. The three day notice is to pay RENT or quit. So perhaps you should pay the rent or offer the landlord the 4 days rent to hold over until the 1st.

they have to give you the 3 day notice, then after that they still have to file with the court and even when it comes to the sheriff coming out you still have 5 days before you can be locked out after that, if the landlord hassles you like parking in front of your house, messing with your utilities, trying to lock you out j( all illegal) the landlord will have to reimburse you plus $100 a day it went on, if harassing you like parking in front of your house to intimidate you , she can be sued for $2000 for each incident, the cops will back you on this.

A successful Unlawful Detainer action against you is public record and will affect your chances of renting or buying a home. Just food for though if you're planning on doing any of these in the next couple of years...
