If she filed it and they dropped it then I agree with the tough crap on the HOA. I would think a lawyer for them would see a filed form and tell them you will not win this.

The kid opening the front door and running into the street that sounds like an issue that can be fixed with a lock in the house. The gate looks like it is there so they can enjoy the front porch and not have to be so hands on with their child. Which is fine and all but something that can probably be handled in the back yard.

As for a neighbor calling the kid names. Sue that person for verbal assault of a child with disabilities. Call the cops for threatening behavior towards the child. etc. see how funny it is then.

I do agree however this is just a stupid gate. I have friends on HOA boards. If you want to prove they got something you better have sent it certified mail. otherwise just handing it in is your word against theirs and they will not admit they missed it.

complain all you want about HOAs till you have a neighbor that uses his front lawn as a car lot for his auto repair business.

As I was watching the video and read the attorney's statement "as long as gate was in conformity with the neighborhood" it struck me, what if someone had to put up a wheelchair ramp. Would it too be criticized?

Okay, just saw the house and the gate; RIDICULOUS that this is even an issue. Shoot, it almost looks like it was built with the house!

I'd be willing to bet she does have locks in the house. I'm sure she's tried it. Children, even ones with special needs, have ways of still getting past that. That gate is one more block in the way of the street and I don't blame the parents for wanting to put it up. They are looking out for their number one.

To think she is doing this to avoid being hands on with her child makes me laugh. It's so easy for people to judge who do not have a child with autism or work with children who have it.

I will tell you from firsthand experience that anyone who thinks that autism equates to "a lack of smarts" is badly mistaken. We are constantly amazed at what our autistic son can do, and he is simply "wired" differently than other children.

What has been so amazing is that in our son's elementary school, the other children have been wonderful with him. He is accepted, and in many ways pampered, by the other students. The kids understand that he is a little different, but treat him the same (if not better) than the other students.

What is sad is that some adults are still ignorant of this spectrum disorder, and treat it like some kind of debilitating disease.

I do not doubt a word of what this lady claims, she has no reason to lie.

However, all evidence points to the fact that the HOA screwed up and is now trying strong arm tactics to cover for their mistake.

I hope she holds her ground, and would be more than willing to stand shoulder-to-shoulder with her in this battle!

I find this ridiculous too... the gate looks decent, match the trims, and is partially hidden from the view. It really looks like a part of the house.
Kid playing always in the back yard gets bored; there is a bit more "action" on the front of the house, and any minute he enjoys it is a minute break for his busy mom. Maybe she let him play on the front porch when she is doing something in that part of the house, so she could keep an eye on him all the time...
Her neighbors are just a bunch of pitiful, heartless jerks.

well said Majorm. I guarantee this boy has the determination to get a chair and drag it to the front door so he could reach a lock to get outside.
