After a witness to the crash followed a Jeep Wrangler that allegedly left the scene, a San Antonio police officer discovered the District 10 councilman lying in his backyard, smelling of alcohol, according to the station. Perry also reportedly had a cut on his head.

Instead of a DWI, Perry is facing charges of failure to stop and give information in a crash with damages, a Class B misdemeanor punishable by 180 days in jail and a $2,000 fine, according to KSAT.

I was unclear why the police officer on the scene failed to perform a sobriety test. Seems to me that was a significant error on the part of SAPD, which seems to be pretty standard.

He wasn't in a car. A sobriety test is worthless if he is not in a car. It's why he ran in the first place. He got out of a DUI and will have an easier time dealing with a failure to stop and render aid.

Pretty smart move on his part, even though he’s an idiot for getting into that situation in the first place. It’s one thing to do this when you’re young but as a councilman? Very bad look for our city

He's a dead man walking.

Only a matter of time before he resigns.

Ah, he doesn't remember.

What a typical, entitled response.

His privilege is showing on all of this, so I'm truly hoping it's only a matter of time before karma slaps the living **** out of him.

I don't get how it is privilege. It seems like there is nothing the law could have really done.

Really? I’m no expert but if you have a witness who sees a guy driving a car involved in a hit and run at 2 pm, and the cops do a sobriety test on him at 2:15 pm after he is no longer in the car, but certainly proximate in time to the witness putting him in the car, I would think one could make a pretty compelling case he was intoxicated while driving. I’m not arguing I am correct; just seems like one should be able to connect the two events.

All a lawyer would have to say is he got drunk when he was at his house.
