According to the linked story he is claiming he only had one beer with dinner and that his being diabetic and having low blood sugar caused the condition that led to the wreck and DWI charge. Can low blood sugar cause one beer to elevate your blood alcohol level to over the legal limit? Was he not tested for blood alcohol level? The article says he was given a sobriety test. I'm thinking this was a roadside agility test. Something seems missing from this KENS5 story.

I he WEREN'T drunk, asking for a blood test would've settled the matter. So, since he didn't request the blood test, it is pretty obvious WHY he didn't.

I hope they followed through on the mandatory blood draw for the weekends around here, like everyone else would have to do in the case that they get pulled over.

Actually, it depends. If he is a Type 2 diabetic, then very likely no (I checked - he's not - he's Type 1). In Type 1 diabetes, however, - a very different condition from Type 2 - alcohol has a paradoxical effect of lowering one's blood sugar. That happens because alcohol is metabolyzed by the liver, and that can interfere in the liver's dumping of sugars into the blood. In most people, this is not a problem - the body just slows down the production of insulin. However, in Type 1 diabetics with basal (and perhaps) bolus insulin on board, the combination can be problematic and result in a catastrophic low which can be mistaken for intoxication. For that reason, many Type 1 diabetics do not drink alcohol. Of course, the real question is what he blew on the brethalyzer or whether they administered a blood test to him and the results on that. If he was over the legal limit, then he was over the limit. Period. However, if the charge is based on the mere appearance of intoxication, then he may be telling the truth.

....and please don't forget the OPEN CONTAINER he had along - which itself is illegal. Not to mention...a Type I diabetic KNOWS alcohol will present a problem, so he does it anyway? Sorry - here's his sign....

he initially refused the field sobriety test.

why anyone supports the spurs is beyond me. this 'man' is a shining example of what it means to be a spur.

put all that logic aside and remember the fact that he had an open container in his car.

i wonder if he's going to have to pay for that fence he destroyed. it IS hospital property after all...

yes, he did. he almost struck an officer, TWICE, while he fled the initial scene.

/he's lucky he wasnt shot after the first miss.
