Not saying she deserved to be shot but she did steal from him and we all know how most Texans feel about people taking matters into their own hands when it comes to stealing regardless of the situation.

Because it was a murder trial, the level of scrutiny is higher. If it had been a manslaughter charge I guarantee he would have been convicted.

Doesn't this open the door for drug deals or any other illicit activities that go bad as well? I can see other defense attorneys throughout the state doing this.

He wasn't robbed. It was a nighttime theft. There's a huge difference. Yes, under Texas law, you're allowed to shoot someone during a nighttime theft. The law should be changed so that it doesn't apply to people who you intentionally invited inside your house and isn't using or threatening force. There is plenty of light inside a home. You are also aware of who the person is and why the person is there.

It sounds like they did, but it didn't matter to the jury. She took his money and didn't provide the service that she agreed to. The law should be changed. I don't see how the situation would have been any different in the daytime. Now, everyone knows that if you're afraid of a prostitute taking your money and you want to kill her for it, make sure the whole incident happens at night. But I'm wondering how they knew she didn't provide the services they agreed to.
