Ex husband has the car in CA
Car is registered under both our names with TX DMV
Car is financed with RBFCU

Divorce pending.

the toll fine letter ($63) was only addressed to MY NAME excluding his - what am I missing?

He can't refi under his name. because he damaged his credit.

At this point or position am I SOL.....?

and by SOL i mean for any future toll fines or speeding tickets?

So how was the ownership of the car addressed in your decree of divorce? I would think the ownership was assigned to one of you though you may both be jointly liable for the debt.

I would make that of issue in the divorce if it's not yet finalized. If he can't qualify for financing, then it needs to be sold, or he needs to find someone else to cosign and remove your name from the title/loan. Sounds like another good example of his immaturity.

Can't you just prove that you were not driving the car at the time? It does seem like you are SOL in regards to preventing this from happening again though.

The simple solution is this... call the State of California and let them know you live in Texas and he lives in California, if you know the address give it to them. Let them know that you are going through divorce. Send them paperwork if needed to prove. If they accept it.. they will send him the bill if they don't you will have to pay. A 63.00 fine will turn into thousands pretty quick with these people. Or talk to your divorce lawyer about it... but in either case make sure you do something. Not doing anything will add to more fines

You need to get your name off that car.
You need to talk to your lawyer and see about doing that. In the meantime, you are responsible for that fine. Pay it and then have your lawyer add it to the settlement.

Then he isn't your ex-husband, he is your husband in the eyes of the law and in any claim you might want to make. The tolling authority won't care that you are getting a divorce. As far as they are concerned, they sent the toll violation notice to the right place, as the vehicle is jointly owned. It sucks, but also demonstrates that the ownership of the vehicle (and any fines or violations attached) needs to be addressed in your pending settlement. There is also the matter that if your husband intends to stay in Cali, the registration will need to be switched to Cali, presumably minus your name. Failure to pay the fine will probably rack up additional charges pretty quickly and he may well be racking up more violations.

For clarity, I'm not a lawyer, but I did go through a very complicated divorce from my first wife, commonly known as Satan. Divorce is hard, hard stuff and my sympathies for the anger that matters like this petty stuff can bring about. You CAN get through it and move on.
