Well, it sounded like the investigation determined that the truck driver failed to take proper evasive action. We don't know all the details and probably won't for quite a while because this is probably headed to litigation.
But it would be interesting to see the full accident report. Wonder which carrier is investigating this claim? I'd love to be right smack in the middle of that.
My guess, at this point, with the limited information provided to the public, is that it is believed that the truck driver had the last clear chance to avoid the accident. "Last clear chance" is a legal doctrine and one of several 'affirmative defenses' put forth in claims just exactly like this one.
BUT, if he was unable to stop in time, AND/OR unable to take proper and safe evasive action, there is likelihood ALSO that he was traveling at an unsafe speed, unable to stop in time to avoid the impact.
I'd be willing to bet they will say that he was unable to SAFELY take evasive action because the size and bulk of his vehicle could have caused the driver to lose control during ANY evasive action.
It will be interesting to see how this lands........ wish I was on this one.....

There's some links to some pretty funny stories about the latest South Park episode on Drudge. I personally thought the episode was hilarious, but I guess a certain movie studio didn't quite agree..

holy crip! there wasn't much left of that truck

and how can you not remember that? The guy definitely needs a drug test if he doesn't remember it. I'm sure the family of the dead lady will always remember it..

I heard on the radio that it caused part of I-10 to be closed for several hours.

according to the KENS 5 6:00 PM news (in beautiful HD of course) that part of 10 is still closed and they said it would be closed for 8 hours. I'm not sure if that was 8 hours from when they were talking or 8 hours from the beginning of the accident. They showed an air view of the scene and the traffic was ugly, so I'd avoid it at all costs.

Everyone should read it.
I had a free subscription to rolling stone and I cancelled it. They seriously don't warrant an effort to point out their flaws and blatant lies.
Besides, I would MUCH rather look at Halle Berry.
