Accident Westover Hills Hunt Ln
My wife and kids were hit by a work van who ran a red light at the intersection of Westover Hills and Hunt Ln/Wiseman Blvd on Tuesday September 23rd. When the police arrived, he claimed she must have run the red light, and since no witnesses stopped it was his word against hers. My children are too young to have know what was going on, so it is left as a he said, she said. If any of you happen to have been driving by and saw anything please contact me. Everyone is ok, just some bruises and burns from the airbag.

Sorry, I wish I could help, but I can't; I just wanted to say that I am glad to hear your wife and kids are OK! I also hope you've been able to recover from it as well.
That scenario is one that scares me as I too have a wife and kids that driver around in a van, and I know how other people drive in this city. And even if the lying scumbag does get away with it now, he'll still have to face his maker one day...

Why did they believe him and not your wife? I'm glad they're OK, too--that's the main thing.

I'd keep on him and mention that you're going to turn up the heat on him by going through his work if he doesn't come clean, or get a lawyer to go after them. It's never a good thing to have your employer come down on you and the mention of a lawyer always gets people's attention. I don't like them at all, but they do have a purpose and some benefits.

^^^^^ I second that. Did your wife say that anyone drove by? If so, and if she possibly remembers what types of car drove by, I would let him know that you have a witness that saw it and is going to give a statement....maybe that would help

Without evidence to the contrary, the police cannot make a determination based on testimony alone unless it is collaborated. How can you choose which person is correct when their stories conflict? A witness would help her case tremendously...hopefully one can be found and then they should slam him with filing a falsified claim!

Can you share what company the "work van" was with? I guess that wouldn't be acceptable to the TOS maybe, but it might help to jar a memory. I mean, a police report is public record, isn't it? When I was in a wreck, my cell phone was ringing off its charger with calls from chiropractors, so they have access to them I know.

Honestly, until it is proven that the driver of the work van actually caused the accident, it wouldn't be right to assume that is the case. I don't doubt Paul's wife; but if for some reason it was proven that she was actually in the wrong, then the company would have been unfairly treated.
Once again, I cannot believe people would witness such a thing and not stop to help out. What is this city coming to?

Paul...I'm very glad your family is alright. Even with bruises and scrapes, a close call can cause PTSD and can vary quite a bit. Watch for nightmares with your kids and extra tension and stress...even depression. I'm so sorry the police made a judgment so quickly.
MM...I disagree. The police reports are public record. As of right now Paul needs help finding a witness. No one can judge what happened here except both drivers and possibly a witness. Identifying the company van might help jog a memory with someone that could possibly help as that witness.

Sidenote
Paul...just FYI....that stretch of Hunt Lane is really bad. Only a week ago a very experience bicyclist was hit and killed near Marbach on Hunt Lane. You may want to do a little research on accidents in that area to support your wife's case.
