As of March he was still missing.

Johnson, 24, has been held in Maricopa County’s Estrella jail on a $1.1 million cash bond since January 2010 on charges of kidnapping, child abuse, custodial interference and conspiracy to commit custodial interference in connection with the disappearance her then 8-month-old son. In mid-December 2009, Johnson took Gabriel to San Antonio in the midst of a custody battle with her estranged boyfriend and Gabriel’s father, Logan McQueary of Gilbert, and stayed at a motel there. She was arrested without the child Dec. 30, 2009, in Miami Beach, Fla.
In a case that has received national media attention, Johnson has both said that she has killed Gabriel and gave him to a couple she met at a park in San Antonio. Johnson maintains that the hand-off of the child was facilitated by Tammi Smith of Scottsdale, who has been charged with forgery, custodial interference and conspiracy to commit custodial interference. Smith and her husband, Jack Smith, initially were interested in adopting Gabriel, but could not talk McQueary into signing adoption papers.

Interesting. The FBI wants to help, but can't as long as SAPD has the case classified as a homicide. There are two sides to every story and this article tells one side. Wonder why SAPD is resisting?

But unless the San Antonio Police Department changes the case from a homicide to missing persons, the FBI can’t even open a case file.

If the San Antonio Police Department changes the classification of the case, McQueary wouldn't have to count on the whim of the woman behind bars.
