I signed a lease sept 13. paid a deposit and prorated first months rent. The following week my husband pcs orders got changed to ft.drum so we called and informed them. But they refuse to give us the rent ad only want to give us the deposit. We never received the keys either can we still get a full refund?

This is a real easy one to answer, does the Rental Agreement/Lease have a military clause for PCS orders? If yes then whatever it says is what you agreed to do. If it has no such clause then you are bound to standard terms of the contract you agreed to. Just because your circumstances changed does not give you the right to back out of a contract with no negative effects unless it was negotiated prior to contract signing.

You might check w/your base legal office.....when you say "won't return the rent" - haven't you already moved in?

Base legal might not be any help because of government shutdown. Lackland had a sign on the door that they were closed, Randolph is open walk-in for deployment related only and nobody answered the phone at Ft. Sam Houston.

Definitely look for the military clause in the lease. Also, has the lease went into effect? If the lease is already in effect you still need to provide 30 day notice so you may be out of the first months rent due to having to provide 30 day notice since you did sign the lease even though you haven't moved in yet.

Obviously I don't know personally all the situation and how much money you would be out.

Most rental places are military-friendly. You could have simply run into jerks. See if someone else outside (lawyer) will offer a free consult to address this issue.

Yep, that's a sane and mature idea. Obviously it sucks to be out a prorated amount for rent, but the landlord is out that money if they refund it.

You must present his written PCS orders, you cannot just verbally inform the owner/management company.

...which is often why there are clauses in rental agreements for military who PCS at a moment's notice. Would this add insult to injury by being a member of the military, as a way of integrating into the community? I would hope clearer heads prevail, not merely at the rental office, but at the corporate office - have you tried the corporate owner of the complex for an appeal?
