What does your mother say about it all? If it's her house, it would seem she has the final say.

Depends on who owns the house I think. Not really up to your brother to kick you out unless he has power of attorney on your moms estate. Even then I would think he has to go through legal eviction proceedings.

Legal eviction proceedings can take up to 6 months.

Well, unless he suspects you've been abusing her, or failing to pay rent in some agreed to capacity, you have lots of options. Regardless, as others have noted, he'll need court papers to have you evicted. Perhaps he's given you 'reasons' not listed here?

You have no job and have been living with your 84 year old mother for a year. She may be in good health, but might be tired of or unable to help you financially or emotionally any longer. Maybe having you and your son living there was just too much for her to deal with. So your brother stepped in and took mom and kicked you out because she couldn't do it for whatever reason.
It's not easy to live with a teenager let alone your adult daughter for a year. You may have some legal rights for awhile, but morally you should leave. Since you have a child, you are probably eligible for welfare or state aid. Perhaps they can assist with lodging, etc.

You have the right to tell your brother to take a hike.
