Hello,I moved my family and I ,into a house that was a converted garage,the place looks great,but then we found out,that the place has one meter,one address for both houses,one mail box (theirs) and what really made me curious was, some one hit our house with their car,and when the fire marshal came out he couldn't quite tell but he did not think the place was built by code ,but before they could be sure,the owner had some guys rush and fix it,something is also wrong with the outer foundation. How can I see if this is a legal house for my family.

I take it you are renting someone's garage? You didn't buy anything did you?

Sounds to me like that conversion was done without the proper permits. If you're renting, probably the worst that could happen is you could be tossed out with no notice. If you bought this, then get yourself some legal aid to get your money back.

Also, if you bought this, how would property taxes be assessed?

The county recorder/tax assessor has maps of all properties. If you bought this, it would show up as a separate property.

Title insurance might cover this problem.

What kind of real estate agent would not catch this?

That's considered a guest house, or granny flat, or in-law suite - and they're perfectly legal in some areas. No problem there!

Not up to code is an entirely different matter, and if it's dangerous you should get out now.

But if the fire marshal was there, and he didn't red tag it? There are actually structures all over the county that were not inspected as they were built. People add on to their homes, and don't get the proper permits, or like in your case, they convert a garage into living space. It not legal, but it does happen. The fire marshal's whole purpose is fire code enforcement, so if he let you stay, he must not have seen anything dangerous.

I think he's renting! He mentioned in the first post the owner had some guys come fix the damage, after a car hit the house - and no former owner would do that - only a current owner!
