Default San diego rental.. end of lease..

I signed a one year lease here that expires oct 31st.. and the lease says i have to move out by end of lease..

Im curious because ive lived in other states, and usually when the lease expires, it converts to a month to month..

So im wondering what will happen if i decide to stay 30 days after my lease expires.. can the landlord evict me before then?

Basically i want to move out November 31st, not October 31st..

What is the exact wording of the lease? More importantly, have you talked to your landlord?

Why don't you contact just your landlord and ask about staying another month? With that said, evicting a tenant is a lengthy process so they couldn't do it in a month. What ever you do make sure you pay the Nov rent so you don't make an arse of yourself and they don't try and ruin your credit.. Unless the lease specifies such, it can't convert to a month to month. Its a legal document, after all.

I agree to just talk to your landlord first. I wouldn't just "decide to stay 30 days past your lease". Even if it's a pain to get your landlord to evict you...it's NOT ethical and not a nice thing to do. I'm sure if you've been a good client, and your landlord didn't already find another long-term client...he'd be open to extending it another month but talk to him first and don't assume anything.

I would do my best to work it out with the landlord............make nicey-nice.

Why............remember, you are most likely going to have to use this landlord as a reference for your next place.

ask your landlord before you ask perfect strangers on the internet.

For a guy who supposedly knows business so well, seems odd you would miss out on the fact that relationships are everything in business.

If the lease explicitly says you have to move out by the lease ending... then, no I wouldn't assume it would convert to month-to-month.

We've rented our current place for the past 2.5 years and after one year was completed per the terms of our specific lease, it become month-to-month.

Like everyone else has said, it's simple: ask your landlord.
