The landlord treat it twice and it keeps coming back, its in the kids bedroom and every now and then i see them re-appearing in their bedrooms, plus I know 2 other units in my building are infected as well.
I also noticed the floor of the baby room is shaky or make sounds like its hollow or broken, not sure if its due to termites. I also see the in the hallway.
I text my landlord that i cannot stand it and it seems like the issue wont be resolved, that i want to move out by the end of the month and want my deposit back, i also told her that I will be willing to show the unit in meantime... no response from her..
what should i do?

I would address the Owner of the property with a letter regarding the issue, with a cc to an attorney.

Not that you need an attorney, but a cc to some type of Attorney will get the landlord to wake up.

Check your lease to see if they have wording in it that they are required to provide pest free residence.

They do, and they have provided it, but i dont think it helps, cause it keeps coming back
2 other units in the building have them and the termites probably ruined the building already.

First, Talk to an attorney. A landlord has a legal duty to make the dwelling habitable.

But in the meantime, Take photos and send emails to the Landlord telling her to correct the issue.

Send an email every 48 hours until you get a response. What should happen...your landlord should setup a treatment plan and pay for your accommodations while you are out of the home.

When is the rent due? If no treatment plan is setup and the landlord is still non responsive Talk to an attorney before giving the landlord another dime.

Probably every older building in SD has termites. Some just worse than others. They are no real threat like some other insects, examples are roaches or mosquitoes.

Have you been attacked by termites? That would make talk shows.

Buildings that have compromised structures get condemned no matter how they get that way. Fire, flood and yes, termites. Naphthalene is far more concentrated from other means than wood dust from termites.

Only to your long-term investment if you're the owner of the building. Otherwise, nope.
