Everyone who thinks that the police have "No right" ot stop you and ask you questions, should look up things like "Common law right of inquiry" and "reasonable suspicion" . Neither of these requires a cop to have "probable cause" to believe that you have or are about to commit a crime in order to stop you, wheteher on foot, a bicycle, or in a vehicle. However, there are also so many city and county and park codes which also allow a cop to stop/ detain you and possibly write you a ticket too. So, if you were stopped and didn't get a ticket, don't automatically think that you were stopped for no reason. The cop may have just decided to let you go on your way.
SDPD is understaffed , underpaid, and overworked, and the vast majority are stand up guys/ girls. No one is perfect, so cut them a little slack until you have walked a mile in their shoes.
I do not have any hate for cops. I have a few police officer friends actually.
I just do not think that cops should get in a persons business at all, unless there is a real, specific reason. Unless there is a call out on me for some reason, or unless I am blatently breaking some law. They should leave me alone.
In the other countries i've lived in. The cops would never do this. I've seen with my own two eyes societies in which the cops don't mess with innocent people in this way. It is very possible to have it like that.
And honestly, is this kind of behavior on the part of the police really lowering crime rates at all? Doesn't seem like it to me.
The USA needs to make some serious changes in it's laws and system. That's the only way to stop the crime.
Almost 2% of the American population is behind bars right now.....
Facts that everyone should know , cops can order any vehicle towed but they cannot order it towed from private property, legally you can demand that the tow co release the car because they have no contracy for services with you .if they don't take them to small claim court you will win the cops have to pay the bill.
Good to know, although I'm sure it will never happen again. I wish the two attorneys I spoke with would have told me this. They took the time to speak with me over the phone for several minutes, so it's not like they were trying to blow me off. Just uninformed I guess.
If the vehicle was used in the commission of a crime, then yes it can be towed from private property.
Then the crime was my roomate allegedly backing the vehicle out of the driveway and causing a light surface scratch on the neighbor's suv. Never actually happened though.
the californiabear, what other countries have you lived in? cops with an attitude happens everywhere, big and small towns. heres an example, im driving my little economy car in omaha, nebraska, and i pass a cop on a residential street. they turn around and stop me, why..cause it looked like i was giving them the eye. god, so its against the law to glance over at the cop now huh. i could of called and made a big deal of it, but would have just been more of a frustration for me, and in the end they could have said i was speeding or done something else wrong. i didnt have it down on tape what they said about them stopping me just because they felt i stared at them for to long. but cops like that are dangerous, i would worry about them over reacting and shooting someone, it happens, and most often the cop walks.
someday there will be cameras as standard equipment in all new cars. might be a good idea at that with starkey and hutch cops like that out and about. i agree with the rookie syndrome, they image themselves the hero, busting a giant drug ring single handedly, just like superman. but some of the veterans begin to perceive it as an us against them kinda thing. i can understand it to some degree as they deal with alot of bad pple. but thats still not a healthy sign, as most pple arent really like the scum bags they so frequently stop and arrest. i was a cop for 3yrs, and i saw several i thought were quite unhinged and wondered how they ever made it through the psychological phase of testing. but as pple have said, its best to be polite and not lose your temper, especially as this person has a gun and the power to take your freedom away.
I have had mixed results, but my experiences tend toward the "younger cops are more aggressive" experience.
I was pulled over twice in the same month, First by an older cop, second by a younger. I treated each cop the same (respectfully, politely). The older cop was by himself and although he gave me a ticket and towed my motorcycle, was pretty chill about the whole thing.
The younger cop (who had a partner with him) was quite the opposite. He got in my face saying "Oh, so you thought you could get away with something? Well, I got you now, what do you think about that?". Its not like I tried to run or anything, I pulled over as soon as the lights came on. I politely asked why he felted that he needed to talk to me in such a way and he got even more irate and said if I keep asking questions, he was going to look into my record and start writing more tickets. I didn't have anything on my record to write a ticket on, but I didn't need him finding more things for me to pay for, so I let it go.
I have been pulled over in my time (on cars, bikes, motorcycles, walking, etc.) for all kinds of things. In my experience, I would rather get pulled over by an older cop because they seem to be more mellow. I don't try to talk myself out of a ticket if I know I am in the wrong, but at least I won't have to deal with the ego-stroke that younger cops seem to get for overpowering me with their "authority".
If you ride at night without a light, reflectors or a helmet you are going to be checked out. It doesn't matter where in the City you are riding. If you look like a gang banger or a tweeker plus the above you'd have to be surprised you don't get checked out.
Usually when you see a grown man on a bmx bike they are usually sketchy. It's a red flag for the Cops.
If you feel like the officer is being unjust or impolite, just start filming them, like with a cameraphone. DO NOT get in their way or they have an excuse to stop you.
It seems that the only way the bad cops gets disciplined is when they are caught on tape/film. Else it's your word vs. theirs.
BTW, I have the utmost respect for law enforcement. I also believe there are a couple of bad apples and that people don't need to torch the orchid because of them.

Ahh yes, the annoying liberal college kids that whip out their cell phones anytime the police are around. "Police state!"

WTF? Do you prefer a cold dark alley instead?
If being educated and open-minded makes me liberal, then maybe that is why I switched political parties 5 years ago.
BTW, those "annoying college kids" are our future.
