Ummm no actually:
San Francisco: Patient and caregiver ID cards issued by county Health Department; no patient guidelines. Case by case consideration, generally contingent on police claims of indicia of illegal sales or diversion to non-medical market. Patient guidelines adopted in 2005 set the immunity threshold at 24 plants/patient plus 8 oz, with a 25 sq. ft. canopy, and 99 plants per collective. |

Sorry Gizmo just stating that California has lax laws on most things prohibited. So outlawing cigarettes is not going to happen unless it is indoors.. Sorry

I disagree, the law is quite clear. Marijuana is illegal to sell and possess according to both California State and Federal law. San Francisco's deprioritization of marijuana law enforcement doesn't make it any less illegal just like Prop 215 didn't.

In fact, San Francisco can't make marijuana legal because local laws are superseded by state laws. The State of California has laws (Health and Safety Code) prohibiting the sale, use, cultivation, and possession of marijuana. California Prop 215 and SB420 do prevent prosecution, under certain circumstances and to a very limited degree, but do not make marijuana legal. As with local law, California laws are superseded by Federal laws. Via the Controlled Substances Act, the Federal Government prohibits the sale, possession, cultivation, and use of marijuana. It's the Federal Government that has the final say in this matter. If the Federal Government wanted to shut down marijuana dispensaries in San Francisco or anywhere else in the country they could, as they have and will continue to do so until the laws are changed. Will everyone be prosecuted, no, it's simply not cost effective. However, electing not to investigate and prosecute does not make the issue of marijuana legality fuzzy. |

Last point (sorry again) Guess what was California's #1 cash crop last year? Not fruit. Marijuana. Seems pretty legalized (decriminalized) if in Groakland for example you can have up to 99 plants for one provider....

Nobody is disputing that a lot of pot is produced, imported, exported, sold, and used in this state. However, the numbers of violations of the law don't change the legal status. |

OK guys... we're getting off-topic now! If you want to have a discussion about pot's legality in San Francisco (which I still don't quite understand, LOL), please start a new thread.
