Default Did landlord commit mortgage fraud?

My landlord received a NOD but since has said he cured the default. He did this I suspect by saying it is an owner occupied property. I know this because he asked to put the garbage bill in his name but he never did. I also have copy of the Deed of Trust and it says the home must be owner occupied within the first 60 days and for at least one year after. He has never lived in the property. I have occupied it since he closed escrow. Is this fraud? How do I report him?

What would it gain you to report him? The lender might accelerate his note and end up with the property, which they would then sell and you would be out looking for another place to live. He would have cured the default by paying up, not by claiming he was an owner/occupier.

Since you have a copy of the deed of trust, there should be the address of the lender on it somewhere. It would be up to the lender to decide to take action. My bet is they don't want to have another property on their hands.
