Hello,

I was in a six months lease in an apartment which got expired few months back. Currently i am paying monthly rent and i guess they will renew the lease soon. If i want to move right now, how many days notice should i give? I am looking to move out quickly, wondering if there will be any penalty considering no effective lease agreement.

It always depends on your particular apartment complex policy so you should ask manager or, as it was suggested before, check your previous lease agreement to figure out all things.

Typically, tenant should give a notice a month before moving out, but it is also can be two weeks or another term in some apartment complexes. So because you currently rent month-to-month, and lets say you want to move out tomorrow without previous notice to your manager, I guess your penalty fee will be somewhere between two weeks and one month rent amount. If you are going to move out in two weeks or a month, there will probably be no fee. Again, check with your apartment complex management. Tip: Do not forget to ask about hypothetical additional cleaning fee and how to avoid it.

I am pretty sure they are going to tell its one month..Previous lease also said so..Posted here to see if any law which says shorter notice can be possible..Thanks for the replies

If you are on a month to month agreement, then you only have to give 30 days written notice. In Ca, that's 30 calendar days. So, for instance, if you gave notice on the 13th, you count 30 days from the 13th.

You can find great info on the CA Dept of Consumer Affairs website. BTW, I used to manage an apt building in Santa Clara.
