I don't know why the link didn't work in my first post, but I found the info again regarding the recall election here.

I have to disagree that he should have been given any leniency simply because he didn't have a criminal record - yet. The problem is minimizing rape as if it's not just as violent a crime as a deliberate attempted murder or stabbing.

Actually, it can. Drugs make people do a lot of things they normally wouldn't, in both good and bad ways. Two passers by saw mere seconds of something that started before then. The fact is they don't know how they got there, they don't know if there was or wasn't consent before they got there. And that really is the part that a lot of folks are not willing to acknowledge, that they are both more than those few seconds witnessed by two guys on bikes.

It seems many of the judge's supporters recognize the registration as a sex offender is a life sentence. The offender is essentially homeless and unemployable for life. That is worse than imprisonment, to my way of thinking. In prison he would be housed, fed, and given medical care. There would be a degree of protection from assault. Out in the world he would have no way of earning a living. Housing restrictions keep him away from schools, day care centers, and any place children gather which includes churches. He will also be at risk of vigilante action. This is a consequence of the registry which is automatic, even though his crime did not involve a minor.

True. But, if he'd been given 3 years, he'd also then come out to all of the above. And even though he'll have a hard time getting jobs, etc., he may not be restricted from getting an apartment. Many places don't do really thorough background checks. And some places only deny certain types of crimes. I've been in two senior apartment buildings now with sex offenders living in them with full knowledge of the management. And nobody ever warned the tenants about them.

I just tried to sign up for that app, NextDoor, and they wouldn't let me sign up without proving I wasn't living with the sex offender they found was living in my building. I have no idea who it is. I was able to find out his name on the sex offender website, but I don't know which old guy walking around in my building is him. And never would have known anyone in my building was a sex offender if I hadn't had this experience.

It's not like he'll have a tattoo on his forehead.

So, I don't think that his probation and registered sex offender status is enough of a punishment for what he did, personally.

It's like you can't commit just a little bit of murder. Rape is rape in my book. This was no mistake. I don't agree with letting people have a free pass because it was the first time they got caught.

And we really need to make sure the message is loud and clear that this kind of behavior will not be treated lightly.

I will say that I do know of one instance where someone was considered a sex offender, and I don't think it was fair. And that was a young man who had turned 18 and graduated from high school, but his girlfriend from high school was still in school and not 18 yet. Her parents turned him in for statutory rape. That was unfair.

That's my opinion, anyway.
