Default Domestic Well Permits

A Judge has ruled that the Domestic Well Statute is unconstitutional. The ruling only applies to Grant, Luna and Hidalgo counties right now. However, the Legislature may now be forced to act along the same lines statewide next session. If you have been thinking about putting in a domestic well, I might do it now before things change.

IMO - Vinegaroon is correct. Anyone who is ever going to put in a well, should think about doing it now while the Engineer is still passing our permits automatically.

Even without the decision, it might make sense to put in a well ASAP. Water rights are by seniority -- so the older the well the better. I know I have a neighbor who is knowledgeable about water rights and he put in a well on a vacant lot that he owns..
