Hi All,

We recently received our utility bill and it showed a previous balance transferred. I've called the SPU and they confirmed the balance was from previous seller. The rep told me that if previous seller didn't pay the bill from a previous balance so now I'm responsible for. She said it's a municipal law and I told her that is the most stupidest law to make new buyer responsible for previous utility bill.

I purchased the home through a developer. I've contacted him and forwarded him the bill. He hasn't responded to me. I also made another call to SPU and the rep advised me to contact the escrow company. I've looked at the closing contract and it states seller is responsible for all the utility bill before the closing.

I've called the escrow company and left a vm for the person who handled our escrow. She hasn't responded to the call. I'm thinking of going to the escrow office and settle this. The bill is due soon and I want to resolve this.

What else can I do to resolve this?

Didn't you have a MLS Form 22K (utility addendum) or something similar as part of your purchase and sale agreement? Your realtor should have incorporated that. In the absence of that, going direct to the builder and making as much noise as you can may be your best recourse. In general, builders benefit from goodwill, not unhappy homeowners picketing outside model homes with signs saying "this builder doesn't pay the damn utility bills "

I looked at the 22k addendum and see that seller should have paid all utility bill at closing. The builder is building new homes next to ours. If this doesn't go well I will make sure future buyers will be aware of this builder. I'm taking the invoice to the escrow place today and show them the receipt.
