Default Snohomish County Sheriff writting tickets in King County

The Snohomish County Sheriffs Dept is apparently is writting tickets in King County. One Deputy apparently will follow you from Totem Lake to NE 160th on I 405 pull you over and apparently write the ticket into South Snohomish County Court in violation of Washington Court rules. If you have this happen you can get the ticket dismissed. I had this happen to me and got the ticket dismissed with the information below.

Besides the regular civil rules and state law, courts hearing infractions have to follow the "Infraction Rules for Courts of Limited Jurisdiction" (IRLJ). Thes set how stuff is supposed to be done. It would eb a good idea to take a look at all of the rules since some relate to pre-hearing procdures, and some to procedures, restrictions and requirements in the hearing. Some rules specifically relate to the fact that the ticket should NOT have been written into that court. Those rules are primarily in section 2IRLJ 2.1 speaks to the notice itself. IRLJ 2.1(b)(4) requires that a specific description of the place the infraction occurred (but look at the whole rule, there is other stuff too.) 2.3 speaks to 'venue' or the proper location of the hearing (in the same jurisdiction as the violation. IRLJ 2.3 requires that the ticket must be dismissed with out prejudice if venue is wrong. 2.2 is initiation of the case. IRLJ 2.2(d) requires that the ticket/notice be filed within 5 days and when not, should (absent good cause) be dismissed WITH prejudice. This is important because at the very least you should be able to get the judge to dismiss the ticket to be refiled in King County.

I had a similar thing happen. I can't remember which police department the cop worked for, but he was off duty and was following me and driving erratically and freaking me out. He wrote me up for three infractions. The lawyer got it dismissed very easily because he filed it in the wrong jurisdiction, I believe. As if cops don't have enough power, they have to go and break the rules/law.

A friend of mine who is a lawyer (ex police officer) told me how to represnt myself. I filed a complaint with the Snohomish County Prosecuters Office.

I got pulled over by a Burlington cop on I-5. I was nice about it since he was only going to give me a warning. Plus, he felt pretty stupid when he asked me if I was from Vancouver Canada whilst holding my WA license.
