Good Afternoon

We've purchased 10 acres of bare land in California. Phoned the correct Bureau Of Land Management Office and left a message with the correct division but there is only two people assigned to the Realty Dept and I am told it will probably be a while before she can return my call.

My question is, does anyone have examples or knowledge of the Cost to obtain a ROW from the BLM??

It is a BLM access road in which a private citizen has placed his own iron gate up preventing the public from accessing it. The County Parcel Map shows it is BLM land and the nearby parcel owners I've spoken with have verified this. They live out of town. There is a nice stream at the top of the property we would love to have access to but wondered a ball park figure concerning obtaining a Right of Way from BLM. And if they would take care of that particular person who has blocked access to it, which others from BLM have said it would be taken care of. Thank you all

Well, I dunno about Commiefornia, but here's how we take care of illegal gates blocking our land in Arizona.

F250 4x4 and a winch.

Anybody unhappy about that can take it up with Sam Colt.

You want to access a stream at the top of an BLM property (that is close to your land?) that another person has blocked off?

Something you maybe should have looked into, before buying that 10-acre parcel.

Just sayin'.

It is possible that said road is a private road paid for by private funds... which has it's own easement across BLM.

Prior to property purchase you should have purchased title insurance with the specific question of access...it is cheap research to find answers regarding legal access & recorded easements.

I have purchased said easements for roads across state lands to access ranch and it was darned expensive...likely cost prohibitive for 10 acres of desert. However, I do not know procedure for BLM.

If your question is about access, if there's an existing road, there may or may not be an easement across BLM already in place for crossing. An existing right of way is usually noted in the deed for the land you bought.
MinerDave has outlined the process for applying for access where there is no historical access.

If your question is about the guy with the gate, that's nothing new. Lots of folks in my state have bought land, locked off access to public ground, and hold it with impunity using it as their own because the government rarely gives a hoot. Ted Turner did this in the Gallatin Canyon and shut off access to thousands of acres of state ground and forest service.

Usually the only way I've seen access restored is through a court case that forces the guy locking off access to remove the barrier.

Good Luck.

The BLM is actively hostile to public access, so you won't get any help from them. Talk to the guy who owns the gate. Chances are he wants security and is irritated at maintaining a road for a bunch of urban mud boggers and thieves. You share the same concerns. Offer to help maintain the road and gate and maybe he will give you a key.

Not sure if I understand what your saying, or if this will help.
Just my own knowledge of our situation....

- Obtain a Permit for accessing BLM land (every year).

You will get a lot of information (and more from going down and talking to a nice person behind a desk)
and a Permit to show anyone that you have legal access to BLM land that they are renting from the government.
The only requirement they told us was to carry Paper Permit or Phone Picture of the Permit to access BLM land.
To show the owner of a Gate.
If Gate Is open, leave it open when you leave.
If Gate Is Closed, Close Gate back when you leave.
