Default Class action lawsuit - any takers?

It's finally happened! Beginning in 1996, I've been keeping info about the hostile environment retailers create on Black Friday.

Well, as you can see by the other thread, a man was killed after being crushed by crazed shoppers....they even took hinges off the doors!

Walmart KNEW this would happen and have for 10 years now. But each year they hold their breath and just hope and pray it won't be 'the year'.

And the victim is an employee.

This is the death. Now let's take a look at all the injuries.

This maddness has got to stop and I am behind the victim's family's law suit. 1 Billion dollars should be the award. 1 million for actual and the other 900k for punitive damages.

Frankly if you can find the people that cuased the death by beatingfdown the door ;I am all wioth teh family. Oher wsie 'its not qal-marts fault. Its like you know that if some breaks in your door at your house they will get injuried. But of course that is why you have a door and peole need to be civilized. I never go near crowds like that because we have seen it time after time with any crowd.But usually they are not this violent .

Blame the freakin' idiots that rushed the store. It's not WalMarts fault that these people wanted to act like savages.

the victim was not a wal-mart employee so let it go! some people evidently have no concept that lawsuits cost everybody money and that stores pass the lawsuit litigation costs on to the consumers. the only appropriate lawsuit is to sue the actual people who did cause the death due to their stupidity and greed, and any jury would convict those people.

Wal Mart was negligent, otherwise the fella wouldn't have been killed, the situation speaks for itself. It's an employer's duty to see that all employees, including temps, make it home from work alive and in one piece. There's a small industry based on the control of crowds with consultants, information and other reources easily available. Anyone with the sense God gave a goose should've seen this was a very dangerous situation.

If Wal Mart wants the profit that comes with this insanity they can take the liability as well.

Just because the cost of lawsuits is passed to consumers is no reason not to sue, that's like saying we can have no justice. Of course if conservatives really believed in "personal responsibility", rather than being apologists for business, they'd think the CEO of Wal Mart should be held responsible and the damages should come from his personal assets rather than from corporate funds. But then one of the intentions of corporations is to avoid personal responsibility.

The only person who's damaged are the decedent (the "dead guy" in layman terms), his children and family. Without damages you can't have a lawsuit. So how do you propose a class action? Who's in the class? Shoppers who have been injured shopping? They each have unique individual claims that make class certification unlikely.

Really? What proof do you have? Internal memos? Tape recordings of corporate management? E-mails from the CEO?

If WalMart could have reasonably predicted that the public would act that way, their actions are tantamount to inciting to riot.

However, if only one person is harmed, where's the class action?

Thats what happens when the herd mentality takes over idiots and results in this type of action from them.
I have never went to the "black friday" sales. I figure if it is still there when I show up I'll buy it,even if its a week later. If not, well they lost a sale.
I don't have to have the first one of anything.
Unless it's the first homemade warm popcorn ball. So I guess I am the same, I just don't throw open the door of the kitchen and run inside. I might hurt someone.
