Actually it reads like this so far:
Section 20-1-110. (A) A common law marriage in this State must not be recognized after January 1, 2008, unless it is established, by a preponderance of the evidence in a court of competent jurisdiction, that the common law marriage existed as of December 31, 2007.
But keep in mind this is just a bill not a law it has not been signed into law and most likely wont be.

You asked about "state" health insurance and SC does have a high risk health insurance pool for those that can't qualify to get coverage in the private market due to health problems. If you meet certain guidelines, there is public assistance available. Here is a summary of the guidelines:

When we looked into it, we called Columbia and went to the courthouse. They both said that SC does recognize common law marriage and that was good enough for us and the purpose we needed the information. This was March 2006.

Is there a form you file to declare that you have a common law marriage in SC? Is there a time period in which you will have to wait in order to be considered legally married? Also, is it a matter of public record?

if you were married and got a divorce, stayed separated for three years. then started living together again, have been together for 10 years. do you have to divorce again? file seprate taxes, but have the same insurance as common law.

I have been living with a man for eight years and he is retired military. He has referred to me as his wife and mother of his children by a previous marriage on several occasions; and listed me as a dependent on his tax return the last two years. Am I entitled to his benefits, pension etc in a common law marriage? And what can I do to establish our common law marriage in SC? Will the courts recognize me as his wife should we break up? His ex wife has not been involved with his children for the past five years. No phone calls or any contact whatsover. Am I now legallly considered their mother according to the courts?

If your common law married in this state the women has all the rights where the children are concened, no if ands or buts if the husband wants to see his kids he must get an attorney and boy will they rake a man over the coals in sumter county...and they will NOT do anything to help the male in any situation...wanna see whats going on with my case? I dont have a problem tellin ya...
