True UNTIL July 1, 2006:

SOUTH DAKOTA CODIFIED LAWS
TITLE 32. MOTOR VEHICLES
CHAPTER 32-23. DRIVING UNDER THE INFLUENCE

SDCL 32-23-22. Chapter not applicable to person riding animal or foot-pedal conveyance. The provisions of this chapter do not apply to any person who is riding:
(1) A horse or other animal; and
(2) A bicycle, tricycle, or other unpowered foot-pedal conveyance.

Source: SL 2006, ch 170, § 1.


Because the statutory definition of a "vehicle" is "a device in, upon, or by which any person or property is or may be transported or drawn upon a public highway, except devices moved by human power or used exclusively upon stationary rails or tracks; including bicycles and ridden animals" the DUI laws applied to bicycles and horses [or mules, dogs, cows, or any other critter you could ride].

The legislature thought that went a little too far, apparently, and exempted bikes, trikes, and animals in 2006.

Correct. Prior to July 1, 2006, the DUI law applied to animals and pedal/foot powered conveyances - horses and bicycles!

I figured it was because it wasn't on the interstate highway system - but then I remembered Juneau, Alaska!
