if a couple are still married is it legal for one parent to move a child to another state in the middle of the night without the other parents concent

Paternity is the issue, not marriage. Both parents have an equal right to determine the welfare and the residence. I suggest you contact an attorney ASAP regarding MO's laws on custody filings and parental abduction.

MO has some peculiar child protection laws. If the state perceives the child to be in danger --- guess who gets the kids? Not the parents. Notice I said perceives. You absolutely need a lawyer well versed in MO child law. Here's the kicker. The state can keep any child up to and including the age of 21. I saw it happen a year ago in Jasper County.

parents must be notified 30 days in advance in writing .also the parent who has costody must petition the court and have a valid reason to leave the state such as change in job,family in the state etc...
