That opinion piece (it's an editorial, not a factual article) refers to a guidance as a law. The guidance isn't a law; it's a guidance, as specified here, on the site of the guidance itself (which was a link WAYYYYY at the end of the article, and the ONLY link to any ACTUAL reference to the so-called law on that entire website:

Draft Guidance for Industry: Dietary Supplements: New Dietary Ingredient Notifications and Related Issues

Quote:
FDA's guidance documents, including this guidance, do not establish legally enforceable responsibilities. Instead, guidances describe the Agency's current thinking on a topic and should be viewed only as recommendations, unless specific regulatory or statutory requirements are cited. The use of the word should in Agency guidances means that something is suggested or recommended, but not required.

The article included many facts. The issue is it becoming a reality. Which will make it the same as a "law".

We have enough burdensome and costly regulations. The FDA has a bad track record imo.

The article cites only one reference for its "facts" and that reference is the link I posted above, which is a GUIDELINE and not a law.

The problem is that the supplement industry is terrified that it finally will have to prove its claims. They will no longer be able to say this supplement "supports" one organ and another supplement "supports" another organ.

If a supplement does anything useful, prove it. Yes, you will have to spend money to do that, but if your supplement is worthless, then you are perpetrating a fraud.

The majority of people in the USA do not need any supplements and will be no healthier if they take them. Those who feel their diets may not be perfect can take a generic multivitamin for pennies a day.

And by the way, herbal products sold in some European countries, especially Germany, are more closely regulated than in the US. Many US products do not even contain what the label says they do and in the quantities on the label.

It doesn't state anything differently than what you said either. It doesn't say it is a law. Once it becomes an FDA practice they enforce it. Plain and simple.
That is akin to debating color of law versus the few real laws. Color of law, I assure you is enforced all over w/ serious consequences.

Apparently you haven't seen what the FDA can do to a legitimate business.

As for being against nutrition. That should be an individual choice to make. There is plenty of regs on making claims. All supplementation certainly isn't the same. Drug companies make worse claims in my opinion.

If you make claims the FDA says it is a drug. That is their rule. There is lots of criteria, regs and studies supporting nutritional supplements.

Plenty of doctors all over the world, do in fact recommend supplements so if you think they are a waste don't buy them.

I mean there is bottled flavored water w/ preservatives and aspartame in it. Hardly call that a supplement. Bunch of junk like lots of stuff you can buy.
