You have interesting logic. I can't for the life of me fathom why it's better to first get out and beat the crap out of someone that upset you in traffic and then shoot them (in an area likely loaded with other innocent people).

It's not better, it's actually all terrible to be completely honest with you. It's just odd for someone to start shooting at someone while driving down the freeway at 80mph..

Here is the a$$ who deserve the death penalty but probably will get some free defense lawyer who will say he is insane and/or it was not premeditated since it was the wrong person that was killed!!!!

2nd degree murder, most likely-- Maximum of life in prison; Minimum of 25 years if a firearm is used, otherwise a minimum of 20.5 years under sentencing guidelines for a person with a clean record per wiki website.

now the news say hes 45 or so-- hate TBO.. it had posted 70... in either case- he will say he was scared out of his mind.. and shot from fear.. time to watch a movie

Nope 1st degree...in a split second 1degree murder is esthablished. This person stated it was the wrong person...so he was out to look and showed the gun and shot 3 times...so evn between shoth is can become 1 st degree and the other thing is that the other person didn't have a gun and wasn't doing anything wrong and already it was admitted that it was a case of wrong person...

1s Degree and dath penalty...I'm not a person who will place a bet but in this case I would almost consider doing it...very sad for the victim and his family!
