Lately there has been a trend by landlords to vacate their properties without regard to the tenants for which they are responsible. Both my mom and a friend are being evicted this month solely because the owners want to use their properties for alternative uses. Both my mom and my friend have paid their rents on time. My mom is being evicted because the owner's family is moving to Florida and need a place to stay. My friend is being evicted because the owner plans to sell the property. Both have leases that end this month. They have both been given 30 days notice, but still have not found a new residence. Any ideas on what to file to prevent their evictions.

I know 30 days isn't a lot of notice...but it is a notice and is likely not "wrongful" unless stated in the lease.

Odd that this is happening to 2 people you know at the same time (with leases ended simultaneously)- what are the chances!

Why don't they just find another place to live...seems they are just delaying the inevitable if each owner has other intentions with their property.

there were some new laws regarding that --look in "MYflorida" or call the information line in Tally and they will put you with right dept...

seems to me that the landlord would have the right to not renew the lease as much as the tenant has a right to move with appropriate notice - isn't that the whole purpose of a lease?

What county? Are you aware of legal aid? Free legal services. Hypothetically, I work landlord/tenant cases on a weekly basis.

There's a difference between an eviction and non renewal of a lease. Your friends aren't being evicted unless they refuse to leave and the LL initiates court proceedings. Which he will do, if he's given them the appropriate notice and they refuse to go.

Since when is a 30 day notice an eviction....?

I work on a daily base with tenants and we have the good, the bad and the liars!

Usually the bad and the liars are in the same group.

If an official eviction is filed than you can almost with a 100% certainty say that it is legitimate since owners are not willing to pay a lot of money to file an eviction that a tenant can fight in court and risking to loose the money and go through the hassle of filling out numerous papers, notarizing some of them if applicable, getting the tenant served, etc.

Therefore I side usually with the LL.

Yes it is SHAMEFUL that an owner of Property wants to SELL IT! It is Shameful that an owner of a property wants to allow family members to live there!! What is this world coming to!!

unless the LL gave the tenant some sort of impression that they'd be able to live there long term - I can imagine that the price of moving every year because LLs do this could be very costly and a royal pain in the neck (having to search for new place, hire moving company, set up utilities, etc etc.....and take off from work).....guess it's a two-way street, though as LL have the hassle of cleaning, repairing, re-listing, re-background check when tenants get up and go and vacate at the end of a lease.
