It's really simple.HOA's exist for a reason.If you don't like the rules promulgated by the developer, then don't purchase a lot within that particular subdivision. If you're a greasemonkey or car restorer who needs to conduct that type of activity at your house, then purchase a piece of property that has no such restrictions, conditions,and the appropriate zoning variances.Most house buyers in most above average communities don't want to experience the effects of a neighbor banging,drilling,machining,draining,polluting, painting,sanding, screwing, jacking, starting, stopping,assembling, disassembling, straigntening,and other noxious activities associated with a commercial vehicle service and repair business.This sort of "hobby" is not conducive to most decent SINGLE FAMILY subdivisions. If it were, it would be allowed.


And don't be foolish, Travolta doesn't live in a SINGLE FAMILY "subdivision". The OP needs to follow Travolta's search however, that's the point.

Exactly.

This is the thing that constantly amazes me as the president of an HOA for a suburban development of nearly 300 homes. When things go south with an owner the first thing that seems to come up is the "I never signed on for this" or "Nobody told me".

Selective memory, no doubt, as Florida has required disclosure of any sort of homeowner's association in real estate transactions for years. We have copies of every owner's disclosure statements on file with our management company and when these comments start being made when there's an issue, they are immediately presented to the owner with the violation letter (if they say something to this effect.)

You get full disclosure when you make an offer if not before, you have to sign an agreement to comply with the rules/covenants when you buy the home. Why would you do this and then purposefully ignore the rules?

My favorite is "I don't remember signing that! There were hundreds of papers we had to sign at closing, do you think we read them all?"

I will say this is the exception rather than the norm. Most of our owners are great people and love the neighborhood and understand the value of the HOA. And we're a nice HOA in that we don't get ugly or nasty with anyone unless they're totally non-compliant and fight us.
