Community Property State
Is Tennessee a community property state? As New Mexico is, so husband and wife are equal on the deed. If we had reduced taxes for seniors 65 and over then both would have to be 65.

Yes, we are a community property state, as every state should be. This is the 21st century.

TN is NOT a community property state...
Unless something has changed recently... According to nolo press, there are only 9 community property states: AZ, CA, ID, LA, NV, NM, TX, WA, and WI.

Wow - you are right - TN is technically NOT a community property state - I'm shocked!
According to another website (divorcenet.com), there are 11 community property states. A different website says there are 8.
Thanks for correcting my error.

Before Bill and I got married, we tried to buy a house. Neither of us were formally divorced yet either and the state of Tn. required that the ex spouses be put on the deed. There was some other obscure worded clause that protected one spouse in the event of a death by the other spouse, but it escapes me now what it was called. It had to do with what the surviving spouse was on the deed. There are some very old laws still on the books in Tn. and I'd ask an attorney about community property.
I know this wasn't what you were asking but it does lead one down the path that "community property" may not be as cut and dried as other states,

My husband and I have been married 48 years and I bought the home that we live in today in 1994 and his name is not on the deed. I got the financing in my name and the bank ask if his name was to be put on the deed and I said no and nothing else was ask about him at all. I am the one that had to be 65 to get the reduced taxes.
