Jeanne61, PA does cease w/death, however, the damage can already be done before death and there is nothing much you can do about what has been done before death. Even if there is a will, PA can clean everything out before death. Unfair, but it happens.

I thought the power of attorney person does not go into effect till the person they have power of attorney over is unable to do these things herself (physically or mentally)
And there are 2 different types of powers of attorney
1. plain power of attorney to look at for the person’s business, to sign checks or pay bills when the person is not able to do any more
2. power of attorney for health care, to make medical decisions, sign consent papers (if the person can’t made the decisions, or has had some sedating medications, or has been made incompetent)

Powers of attorney can vary quite a bit from one to another as to their allowable use. There are unlimited powers of attorney that allow the agent to sign virtually anything on the behalf of the principal (such as a durable power of attorney you may have filed along with your will), or the document may restrict that power to any specific action or actions. An example of the latter is a power of attorney you may be asked to sign giving a car dealer or insurance company authority to sign your name to a car title. The only way to determine the specifics of any power of attorney is to examine the original document.

If it's a durable power of attorney, it does not cease with the death of the principal. In fact, it may even be written so that it only becomes active upon death.

Sadly, this is turning into a legal advice thread and not about a homestead being built in Tennessee. If that continues it will have to be closed.

ForestBreath, I really feel for your situation. Hopefully the Masons will be able to get involved. This is what I see... a lot of times, older women, who have been recently widowed, are so unused to making thier own decisions that they become easy prey for any man who happens to be around at the time. Hazel probably never made any major decisions on her own. She probably just is so used to having the man have the final say, it was a relief when this "preacher" came along. As hard as it is, please try to make sure no harm comes to her, from this man's interference. Maybe your husband could take a more active role in y'alls relationship (I get the feeling you've been doing most of the communication or whatever). Have him offer to go check on her, do minor chores, whatever, if he is willing. Hopefully she will see who has her best interest at heart.

I am praying for y'all to resolve the situation. God Bless.

Chris does do a lot for Hazel. He has done things like fix the clothesline, trim shrubs, fix the garage door, carry things to the loft and even jack part of the house up and fix the foundation. He has been gone for two weeks and will be back tomorrow, thankfully.

I appreciate the advice and thoughts from everyone in this thread. Things like that make an internet forum a "community" and I have made some good friends here.

The weekend is behind me and I only have one more night before Chris will be home. It has been a tough two weeks, but I have made it through it so far. I have to be honest and say, at 46, carrying wood, water, fixing small home problems, taking care of all the animals, moving furniture, dealing with trespassing deer hunters and keeping a fire going, plus working 40+ hours a week has not been very easy. LOL But, I am proud of myself for managing it as well as I have.

Yesterday evening, Cletus was barking out by the picnic table. I finally went out to see what was going on because if he barks at varmits, he chases them and it is a very agressive bark. I went out and saw nothing so I headed back in the house. It was odd that he did not follow me in. He kept barking and moved down the driveway a bit, looking like he was watching something. So I headed back out with the 22 rifle, because if it was the bear, I needed something of that nature. Well I looked again and discovered a man going up a tree right beside the pond with a tree stand. I suddenly forgot I was an old woman alone in the boonies and was pretty mad about it. So I raised the gun and asked what the * he thought he was doing. He said, "I am fixin' to hunt deer". I said "Wrong answer, try again". Then he asked if that was a house "right there". Well now, I know my home is not the best home in the world but you would think with the porch, clothesline, outhouse, woodshed, a fire burning with smoke coming from the pipe, a family dog, chickens running around and 8 cats....uh plus a car parked out front...one would KNOW it was a house. I told him he had about 2 minutes to get off my property. He said "that old woman" told him he could hunt there. I asked what her name was and he did not know. I called Hazel, she was not home, but I managed to reach her at her friend's house. She did not give him permission so I called him a trespasser and a liar. He said he USE to hunt there and there was not a house last year. I said there is now and I own this place now so leave and tell your friends to read the signs before they come watlzing in there again. We put up 50....yes fifty....no trespassing/no hunting signs. So he left and I gave Cletus a big hunk of deer jerky for being such a good dog. He did not leave my side the entire time. Not too bad for a half hound dog from the shelter.

Aside from that, I have worked very hard the past two weeks, particularly this weekend. Canning two deer took a lot of time. This weekend I decided to take a break form canning and I made myself a closet. Grant you it is not a cut wood and nail it closet, but with everything going on a real closet got shuved to the back of the priority list. We were hanging our clothes on hooks on the wall. So I moved all of our six foot bookcases, 5 of them over to the corner and divided off a small room with them. I bought clothing racks and put behind there and on the end I put my antique cabinet that we use as a medication, bathroom, catch all type device. It makes a perfect walk-in closet and I don't have to look at clothes hanging from the walls now. I also moved the buffet by the bed and re-arranged a BUNCH of other things. Chris has the camera in Michigan, so I won't be able to get pics until he gets home tomorrow, but I will post them later.

I also carried in lots of wood, worked on the floor and carried in 20 gallons of water so Chris won't have to carry any when he gets home. OH...and I started a compost pile not long ago and that will go on the garden when it is ready.

Other than all that, I am waiting on Chris. Our first priority when he gets here is do the ceiling. I am buying the wood for that with my Christmas Bonus. We are also going to wrap the house in the next week and start buying the boards for the siding. SO....we continue on. Hopefuly my next post will have pictures!

Forest Breath,
You go girl! A female your age carrying in all that wood and water and chasing off a trespasser with a shotgun has my upmost admiration.(And I mention your age with the upmost respect as I am only 2 years younger then you.)

Boy I am tired just from reading your latest post! I don't think I could work that hard and enjoy life, but this is the choice you have made and I really respect that. And thank God for good ole hound dogs, I recently rescued one and he is THE BEST!
