Question using military orders to get out of lease

hello, im new to this site in my search for answers to a dilemma. i hope someone can give me some advice or information.

well, my husband joined the military in january of last year. he got orders to go to ft hood. i was 9 months pregnant at the time so we decided to wait for me to move until our baby was born. but he was then told he would be deploying in march, so we decided i would stay in waxahachie until he came back. our plan was that he would live at the barracks after the deployment since we were going to stay stationed at ft carson in july. there was no problem back then.

now my husband just found out that he will only be able to stay at the barracks for 30 days at the most. so we then said we needed to find a place in ft hood so we wouldnt be paying rent at two places.

well, we both thought this would be easy since he will be getting his orders for carson sometime in may and we could use those orders to get out of our lease. but my apartment manager said that even though we get orders in may, we cannot get out of thelease without breaking it until july(which is when we should be moving to carson). i'm new to the military life, so i wasnt so sure. but i always thought that once we got the orders, we could use them to get out even though there were still 2 months left before having to leave to the new duty station. i guess my question is, is the apartment manager right? i have tried contacting housing in ft hood, but no luck so far.

since you are not on post now, and cant walk into the buildings where you can get help/advice regarding this, i would call the armyonesource number. they have tons of help for every issue you can think of, on the phone. you will get out of the lease.

I agree. Call onesource Stateside: CONUS: 1-800-342-9647. If you live close to a military post and have your current military ID, call the switchboard and get in touch with Legal, they should also be able to help you.

Check your lease - does it have a military clause? The clause will say that the lease can be broken if you get military orders to move. You will still have to give notice (which sounds like you did) and submit a copy of your orders to the apartment manager.

it does have a military clause. now the apartment managers are telling me that even if i get the military orders in may (which my husband thinks that will be), we cant get out of our lease until july which is when he has to be in ft carson. this is mainly what was confusing me. thank you for the replies.

oh, and i did call that number, but told me the best thing to do was contact legal in ft hood, whcih i have been trying to do with no luck. i guess their phones are always busy.

keep trying legal on post. also, does your state have an association for guidelines for tenants/renters? Texas does. if a landlord violates the guidelines, you can get support from them too.
no worries, if you have the military clause in your lease, you are good.
fight to get your deposit back.
