Unemployment Appeal in Texas? (Bryan: lawyers, look for a job, living)

I was terminated for bad product (being off specs). I went to apply for unemployment. The employer denied benefits stating that i was terminated due to failure to call in. And I was denied Unemployment benefits.

I have filed for appeal but am not sure how handle. I supervised the night shift. Both shifts failed to produce the product with the correct spec requirements. The day supervisor was written up and I was terminated. I was never provide with the termination form to sign or enter comments. I was never told I was terminated for failure to call in. How should I handle this? It is employers word against, mine.

File an appeal and tell them why you were fired and that it does not agree with what you employer say and they will look into it.

A neighbor of mine filed for an appeal. She was "fired" along with 10 other employees but it was really a lay-off but the company came up with reasons to fire people instead of doing a lay-off.

She appealed and they had her submit a written statement of her side of the situation. And they had her former employer submit their statement and evidence. They ruled for her, but then the former employer appealed that ruling.
Then, they had a phone "hearing" where both her and her former employer were to call in at the same time and they would have a "hearing".

I couldn't tell you what happened after that. I lost touch with her.

To be honest, I think you'll have a hard time winning if they can prove you did not meet the requirements - even if the other person was just written up. But I guess it doesn't hurt to try.

Yeah, unemployment in Texas stinks big time. Takes so long to get an Appeal Hearing and approval. Biggest gripe is that there is no in person walk in office. Living here, you gotta have a big bank account in case you get unemployed and don't get benefits,

My temp $60/hr 2 day scab job messed up my unemployment and it took me up to 8 weeks to get it straightened out.

Jesse69--so sympathy from me when you are trying to eat the cake and have it too--

OP--can you get testimony from the other terminated employee or from anyone at your job --know that is difficult if some of them still have jobs there...
do you have any sort of a union--which I doubt--since TX is anti-union state and this situation is exactly why workers need unions...
were you at your job on time?
do you have history of being late or taking sick leave w/o calling in?
ask to see the termination form at your hearing

any way to prove you were at work on time--like your car has a GPS system that would show its time and location at a give date--you can get info through the GPS main system I think...

I am trying to find out why my last apppeal is taking so long I understand that lawyers have to be involved but if the hearing officer on Oct. 20th had done her job properly she would have gone in my favour considering all 4 woman involved for Bryans Smokehouse lied under oath about me leaving work early on july 3rd 2009 and had Ms. Johnson done her job and requested the proper paper work then I would not have lost my appeal. do you know how hard it is to look for a job and not have any money coming in and should not be that way but i am stil looking and going way beyond my area to find one .
