Has anyone been following this story? To summarize:

-Police were called because a young woman was intoxicated and vomiting in a cab
-Two police escorted her up to her apartment
-The two police then returned three times to her apartment
-The officer accused of rape has admitted making a phony call to 911 so that they could return to her apartment
-Women claims that one of the officers raped her, the officer denies it
-Women confronts officer about a week or so after the incident, before she has filed charges, to talk to him about the night in question. She is secretly recording the conversation.
-She asks him questions like "did you use a condom", "I need to know if I am safe/possibly pregnant, etc.". His repeatedly replies along the lines of what are you talking about, nothing like that happened, etc. Ultimately he says when asked again if he used a condom "yes, you have nothing to worry about", but even then his reply is somewhat evasive and implies that he is denying anything happened.
-This week he has been on the witness stand and has admitted to returning multiple times to the apartment, making the phony 911 call, and also briefly lying down in bed with the woman in response to her request.
-He has strongly suggested in his testimony that she was sexually aggressive towards him and tried to initiate sexual contact, which he claims he resisted.
-There is no DNA evidence that was collected that ties to the police officer.

I find this case to be fascinating because the stories are so different and obviously someone is lying. I like to think the best of people, but in this case I don't see why the woman has a reason to lie, but it is clear why the police officer would have a reason to lie. Still, I just find it hard to believe that someone, especially a police officer, could take advantage of someone in that condition.

Police officers are the biggest gang of liars on the planet. I'm not saying that they are lying in this case but in my experience they can do whatever they want and almost always get away with it.

I'm thinking they will get away with it in this case as there is no DNA evidence.

Taking advantage of someone who's incapacitated is SOP (standard operating procedure) for rapists. These guys are always looking for someone who's easy to pick on, someone they can use for sex and get away with it -- drunken victims are perfect because they're woozy and uncoordinated, maybe totally unconscious, and are less likely than average to remember later that it happened.

ok. I want to start with a disclaimer. I don't know what happened in this case. I don't know who is lying. I am not defending anyone. I am just answering the above. Sorry for the disclaimer. I just don't want to be misunderstood which is very easy on C-D.

The woman may have a reason to lie. People are desperate for cash right now. What better way to get cash than to sue the police department, the city, and the individual?

Again, I am not saying this is what happened. I do believe they need to investigate because these are serious allegations. I am just saying that she does have a reason to lie.

Also, because she was drunk, she may be remembering the event wrong. It was wrong of the cops to return to her apartment. She may have remembered them in the apartment and thought something else happened. Just thinking it can make it real to some people.

btw... I play Devil's Advocate a lot. I am a middle child so I can usually see several sides to each scenario.

Why did they continue to return?

And then the phony 911 call?

Even if the woman was "begging for it" she was obviously drunk and in my opinion that's rape. Who wants sex with a puking drunk anyway?

I've heard a few people suggest that but it just seems so hard to believe--to go through all of this for some financial gain? Granted, her name/face isn't in the paper or anything, but isn't this far too humiliating? And you ultimately may get nothing?

For example, one piece of evidence that came out in the investigation was that the DNA of 3 different men was found on her bedding, none of which was the officers. Um, that's awkward. Your whole family/friends hear about this?

I believe that this woman was/is 100% certain that she was raped. Otherwise she wouldn't have confronted the officer days letter with a tape recorder hidden on her. But in reading the transcript of those recordings, I tend to think that what she thinks happened didn't happen. I think if the guy genuinely did rape her, and he saw her coming to confront him, he wouldn't have chatted with her for as long as he did. He would have simply walked away.

My guess--the guy was smitten with her and attracted to her. She was drunk and flirty. He wasn't sure what to do but he kept coming back just to see what happened and because he wanted to see her again. Ultimately, some inappropriate contact happened between the two but stopped short of actual sex. She woke up the next morning and in the sober light of morning realized that something happened that wouldn't have happened if she were sober. Did she think she was actually raped? Or did she just make that up? I don't know. It's a really interesting case...

In case anyone is interested, here is the transcript of the recording that was made when the accuser confronted the police officer in the days after the incident: Full transcript: Alleged 'rape cop' Kenneth Moreno meets with his accuser - New York Daily News

He said, she said...it is a wash.

No one "asks" to be raped, but women, please do not get so drunk you are slobby, and vulnerable. Why didn't she go to the hospital and have a rape kit done? She did not have to name her attackers, and would have had evidence. Why would a rapist go out for coffee with his victim, and discuss the "attack"? I am thinking that rapsits don't give their victims their cell number, and meet for coffee a week later...just sayin'

Men, dopes! Don't screw drunk chicks! Even if they beg for sex, just leave. There are weird psycho chicks out there, that will lead you on, and cry rape the next day. Happens all the time. If this guy did it, he is beyond stupid. He has messed up his entire career for a piece of vomiting ass?

Cops lie like rugs. The line between cops and bad guys is razor thin. Sometimes non-existent. But women have lied about rape. So, looks like a wash to me on this one.
