Robert Stewart was found guilty of murder Saturday in North Carolina. He gunned down eight people at a North Carolina nursing home in 2009 during one of the worst massacres in NC history.
This was a death penalty case but the defense team was able to convince the jury Stewart lacked the premeditation and deliberation necessary for a first-degree conviction.
A six weeks trial and the jury deliberated two days (sound familiar?) and returned a guilty verdict of second degree murder. The judge sentenced Stewart to roughly 141 and 177 years in prison.
District Attorney Peter Strickland said after the verdict that he would have preferred a conviction on first-degree charges. "I apologize to the families for not being able to get the convictions we were hoping to get," he said.

Stewart entered a nursing home with multiple weapons and started shooting people. He was upset with his wife, who worked there. While he looked for her, he shot residents and staff.
The anger is because he was not convicted of first degree murder. He was taking xanax and ambien and the defense maintained this made him somewhat of a "sleepwalker", thus, incapable of premeditation. It's a slap in the face of the victims' families to buy into the ludicrous argument that this was not pre-planned.
That's why people are upset. Second degree my foot. However, he will never ever get out of jail, so that works for me. But I did not have any friends or family killed during this rampage.

I agree the sentence works for me too ... at least the jury didn't let him walk. He will be serving some hard time in Central Prison in NC ... that place was built in 1884!! It has been remodeled over the years but it's not the Hilton of prisons.
