hello I have a question that has me a little befuddled.

I just received my check for the period ending 8-21-2010, today on September 10th. However, I usually get payments for 2 weeks. The week missing is 8-28-2010. Is the reason I didn't get 2 weeks worht of payment cause I refused a job?

Extra information, even if it might be too much. I applied for a job as a sales representative after reading an AD online on Caljobs. I got a response back with interest in the company. After I googled the company and did research on them, I found out they sold DILDOS and other PERSONAL EROTIC TOYS. Needless to say, I was not particularly interested in this work... Having told EDD that I rejected work this week disqualified me? Was I better off not indicating that I was rejecting a job because of the morally questionable type of work involved? Now I am down and out on a weeks worth of benefits, and with the check, they didn't send me last week and this week's claim form. Simply a form that says DO NOT COMPLETE OR RETURN THIS FORM.

I am so confused

Did you actually refuse an offer? If you did then yes you are not allowed to refuse a job that is reasonable. Only thing you can do is appeal and tell them about the situation and see what they say at this point. If you didn't refuse an offer from the company I dont see why you should get cutoff. Although you told them that so that is why they cut you off. All I can tell you is appeal it and explain it to them. The appeal process could take some time though.

Uh oh.

Here's a situation where sometimes 'omitting' information would be best. Even though I go by the old adage that 'honesty is the best policy'......not in this particular case.

Since you didn't actually have an offer but just a mere interest expressed, you weren't actually turning down a formal position. Yet EDD sees it differently. I would have never mentioned the job prospect. Once you learned about the job being in the sex toy industry (personally, a sales job is a sales job so I would have grabbed it seeing as there is probably big sales involved ), I understand your moral issue. I don't have that moral issue in that it isn't actually porn or sex for sale, just toys that most adults (and some teens )have in their drawers....I bet there's big money in that industry. Beats UI......

Did you interview? Did you investigate company you were actually submitting your resume to BEFORE submitting it? Did they set up an interview or did they just respond to your resume- what do you actually mean by showed interest in you?

Lesson: If you could google the company beforehand, that would be best so at least if you have lines drawn as to the kind of company you are willing to work for, you'll know before you submit your resume.

I would call EDD and speak to someone about it and find out exactly what went wrong and request to appeal the decision. It might be that you will be punished for only a period of time and not completely disqualified from collecting.

Hey- will you post the company.......maybe some of us who lack that particular moral issue would like to apply!!!! Just sayin'

Man this sucks. This is the second time that I have misinterpreted what they mean on their questions form and its going to cause me a massive delay. The first time, I signed up for a testmasters lsat prep course so I marked Yes, I have begun school/training(although the class is only 4 hours a weekx2 days) Then they postponed my benefits till the interview 3 weeks later. They call me ask me to explain, and the interview process is about 1.4 minutes when as soon as I tell her its a prep class, not an actual university, she resumes benefits. This time, I thought by rejecting an interview that means I rejected work and again, now I am going to have to wait 3 weeks for everything to clear up. I didn't get anything in the mail saying that I was denied or anything along those lines, just no benefits paid for the week I marked yes.

This is such a broken system where its better to lie and say no I did not refuse work or no i did not start class because if you mark yes, even if it is an exceptional situation, then you get screwed over.

P.s. it takes sooooo long to get in touch with an employee over the phone I am so screwed.

You definitely need to call EDD (you might need to go into a local EDD/CalWorks office and use their phones if you want to get through) and straighten this out. Don't just assume EDD will contact you.

If it comes down to it, California EDD does allow you to refuse work for moral reasons:

But like others have said, you didn't exactly refuse a job offer anyway.

Thank you all for the information, I appreciate your responses in helping me figure out this very difficult situation for me.

If anybody else can answer these other questions I would also appreciate it.

1-I have submitted a form on their contact EDD thing online, trying to explain my situation. I have gotten responses back pretty quickly this way but do you think this will suffice?

2-Are they open on saturday/should I get a response saturday if I try calling all day or something?

I really don't know what to do, seeing as I have no mailing from them explaining what I should do in this situation, so all your help is much appreciated...

Unless there's an "obscenity clause" in the reject-work criteria, you may be in a bind.

I remember my previous period of unemployment where I was kicked off UI immediately for quitting a job on the first day (I knew I wouldn't be able to stand several annoying co-workers for 40-hours a week; life is short). I kind of regretted being honest about that, but the economic Ponzi scheme hadn't yet collapsed back then and I didn't need UI benefits for long.

If you didn't reject a job offer, or start a job, there shouldn't be a problem. I quit a job after a month because they had no more work, and didn't have a problem starting up my unemployment again. I just filed a new claim.

Yes, telling the TRUTH is why you're not getting paid.

What would possess you to do such a thing?

Honesty is not always the best policy. Being that you're in California you're lucky you got the week they did give you. Good luck trying to get it reopened.
