That is good advise if you haven't worked and don't qualify for a new claim at a reduced benefit amount. If you are receiving a higher amount (still get EUC checks) don't call them an open up a new claim. Wait until they stop sending you checks and they inform you that you need refile and open up a new claim.

Hi People,
I'm in CA.
I'm new in the forum, and read many posts. Still like always has questions. My question is similar that was posted in this topic,
So, I'm receiving my EB for 1 year, never work for this year. And my Claim expires on 04/09/2011. (tomorrow)
I just started receiving my Second extention (Tier II)
Going to mail on sunday another continues form for past 2 weeks, (March 20, & March 27) And hope to receive this check by end of next week.
I read all comments and just today decided to go to the EDD local office to ask next action. They told me that I need to open the New Claim (and told me that I can do it today, April 8) Also they told me that I required to register with CALJOBS (like Aquaboy said). I did not make any action yet. Just decided to read all topics again to make sure that all goes right.
So, as I understand I better just wait? Is it possible that EDD automaticly will move me to the next Year? Or I MUST to call to EDD and Re-Certify? (or open the New Claim)
Office reps. told me to Open the New claim, but I read here that its not good idea to open the new claim before ends Old claim.
Again after all its kind confusing what right action should be.
Please, again, what is correct step?
P.S. Also just called to EDD 10 minutes ago and they told me that EDD do automaticly, moves to the next Claim year, with no action required from me.
Now question who to believe? Probably right decision will be to wait? Or probably call 10 more times to speak to other reps.?

I'm going through the same situation as well. I was laid off April 23, 2010 and have not worked since then. I emailed EDD on 4/9/11 because I hadn't received my claim form for the weeks of 4/2 and 4/9 which would be the start of Tier 2 for me. I ended up getting the claim later in the day in the mail so it wasn't lost or anything. I did get a response back from EDD on Monday the 11 and he said it was sent and then added this:
In addition, your 12 month claim ends 04/23/11. Please call the EDD as soon as possible at 1-800-300-5616 to file a new claim, or file online at [url=http://www.edd.ca.gov]Employment Development Department[/url]. All checks, including those from the extension will stop on that date, unless a new claim is filed.
So, like everybody, I was confused as to why I had to file a new claim since I was on Tier 2. I replied back asking why and when do I file for this new claim...on April 23 or before hand? Their reply:
Your prior claim expired 03/05/11 and a new claim needs to be filed by you with the effective date of 030611. It can then be determined if the new claim is valid/invalid. If the new claim is valid then you will be removed from the federal extension and placed on the new claim. If the new claim is invalid then you may continue on the federal extension until the next quarter then this process is repeated. If you mailed in a claim form it is being stored until it has been determined which claim you will be collecting from. Then your check can be processed.
Needless to say, I'm confused by their dates in the second response? Is that an error on their part and meant to say 4/5/11? Not sure what to do?

This is very routine. In both your above cases, On your 1 Year Anniversary, you must call in to re-certify. If you hadn't worked In The Last Year, you will just continue On Whatever Extension you are on..just call and do it.

I am in the same boat. My first year of benefit expired on 4/10. Just received a letter "additional instruction" requested by EDD that I needed to file a new claim immediately, or no further payment will be issued. I am actually just started receiving benefit on Tier 2. After reading the posts here, I decided and went ahead to file a new claim online. I did not work at all last whole year. So I filled up the application with the exact same information when I first filed for UI. I called EDD up twice, and spoke to 2 reps in just few minutes hold. Both of them said the same thing that I had to file a new claim. They explained that they were not allow to make any further payment after the first year of benefits was expired. Now, I just hope this is a sort of procedure, and they will continue my benefit where I left off, which is Tier 2.
I also realized on the first payment of Tier 2, they stated that they will give me 13 week of benefits, which I thought it's supposed to be 14 weeks. I asked the EDD rep, and she said they will combine Tier 2 to Tier 3, which I did not really know how it works. But she started get impatient with me. I decided that may be I should call back later to talk someone else.
Si, I will update what's going on with my situation. I am crossing my finger now.

It states any claim I file hereon will be invalid..???
But the box is also checked that says this wont affect any claim for EB!
Another line states my claims will be valid again in July 2011.

I just got the same letter today!I got the invalid claim section 1277 and underneath a few reasons of why i don't qualify for an extension. Then below that it states that this determination does not affect your claim for extended benefits. My claim expired 4/16/11. There was another form that i have to send out if i want to appeal.Is this what you got. I'm on the first 13week extension ,having 9 weeks left on it. I haven't worked since 4/16/10, having a family to feed i'm worried as hell. Was your letter the same as mine? Any advice on what to do would be greatly appreciated by you and anyone else. thanks.

I think youre at your 1 Year Anniversary. U need to call and recertify. If u have any problems with this send me a direct message

I appreciate it. I just called and explained that i received this letter. The lady said that the new claim was sent and rejected,and that it doesn't affect my extended benefits,that i don't have to do anything else. She said i'll continue receving all the extensions throughout next year. She said to just fill out the bi-weekly claim as per usual. Thanks for the help.

This varies from state to state. In some states you can do your one-year recertification on line; in others, not. Check your state's website for info before proceeding.
