It sounds like there will only be one week to exhaust benefits in to qualify the week of the 19th?

What is also strange is this: I am scheduled to exhaust my clam on sat 5/5/12, but I have not yet sent in my claim form for these two weeks, so how could edd already have my tier 4 extension filed for me for the 5th? do they have the ability to flile these extensions retro-actively? because you certify for the prior two weeks, usually several days after?

You can exhaust Tier III for the weeks ending 5/19 or 5/26 and become eligible for 16 weeks Tier IV.

In my message above, I state: I live in North Carolina. I completed my Tier 3 benefits on 5/5/12. If I Completed = EXHAUSTED ON 5/5/12. Then what you are saying is that I should:

Stop claiming for two weeks. You're going out of town b/c of family emergency, etc.
Reopen your claim for the week beginning May 13 (i.e., exhaust Tier III on May 19th).
You will then be eligible for augmented Tier IV.

How can that help me when I EXHAUSTED Tier III on 5/5/12???

You don't file your claim for weekending 5/5 until today or no later than 5/11. You can NOT exhaust on 5/5 unless you already put your claim form in the mail, or filed on the phone/computer way early this morning.

Exhaust dates are the weekending dates for the week you claim, not the date you mail in your claim form, not the date the state releases the funds, and not the date you cash the check/debit card gets loaded/direct deposit hits.

You haven't exhausted that tier until you actually submit the claim.

Joker, have you already submitted your claim for 5/5?

May 5 was just yesterday. You wouldn't be claiming that online until today, earliest. Or, have you already mailed it in?

As Chyvan says, if you already submitted your claim for 5/5, it is too late. If you have not yet submitted your claim for the week ending 5/5, don't. Call NC on 5/14 to reopen the claim to exhaust Tier III on 5/19 (you would be submitting claim AFTER 5/19).

Some one told me that I should fight for the remaining balance!

OK - I now understand what you are saying: “Exhaust dates are the weekending dates for the week you claim” NOTE: To date I did not file for week ending 5/5/12. I did re-reviewed my benefits and here is what I now understand - [I Hope I did not burn myself here] - My Tier 3 benefits actually finished on 4/21/12. For reasons unknown to me, NC ESC "KEPT" and did not pay one week of my Tier 2 benefit until 4/28/12 = the week after my Tier 3 completed. Now NC ESC states that my week ending 5/5/12 is my first week of Tier4 benefit. Did I burn myself out of ten additional weeks of benefits???? Important fact: A few weeks after I started receiving my first 26 weeks of benefits, I earned income and reported that income on a weekly claim. Doing that should have kept more money in my Total Possible Benefits bucket and extended my benefits out by one week resulting in Tier 3 ending on 5/5/12 instead of 4/28/12. I feel that my Tier 4 determination is not correct and that I have a right to protest. 1) DO YOU AGREE? 2) Should I JUST GO A HEAD AND FILE FOR WEEK ENDING 5/5/12?

You have already exhausted Tier III with the 4/28 claim so, unfortunately, it is too late to qualify for augmented Tier IV. Earliest to exhaust Tier III to become eligible for augmented Tier IV would be with week ending 5/19, as we've said.

Certainly, call NC about how your state benefits were paid. You might want to hold off filing for first week of Tier IV week ending 5/5, until you've talked to them. Again, get out your original letter. Did NC pay you that exact total dollar amount stated in that letter, or was it less b/c of your earnings? I find it hard to believe they reduced your total monetary determination with the amount of your part-time earnings - although that may be a wrinkle in the NC UE Code.

Let us know what happens.

Under the Middle Class Tax Relief and Job Creation Act of 2012, fourth federal extensions filed in California with an effective date between November 8, 2009, through May 6, 2012, provide up to 6 weeks of benefits and fourth federal extensions filed with an effective date of May 13, 2012, or May 20, 2012, provide up to 16 weeks of extended benefits.
If the effective date of your fourth federal extension is between April 1, 2012, and May 6, 2012, and:
  • You want to qualify for the increased potential maximum of up to 16 weeks, AND
  • You are willing to give up your extension benefits for weeks between the effective date listed on your Notice of Fourth Federal Extension Filed (DE 6331EUZ-E) and May 13, 2012. This means that you may only receive weeks of benefits for weeks after May 13, 2012, AND
  • You are willing to wait from now until at least 2 weeks after May 13, 2012, to resume collecting federal extension benefits. The EDD cannot pay you until you certify for benefits. The first claim form following May 13, 2012 will not be due until May 27, 2012. This means that you could experience a delay of benefit payments of up to several weeks.
You need to LET THE EDD KNOW RIGHT AWAY (by selecting the Continue button below or calling the EDD) that you want to cancel your fourth federal extension to try to qualify to receive up to 16 weeks of benefits. DO NOT MAIL YOUR CLAIM FORM TO EDD, OR CERTIFY FOR BENEFITS USING EDD TELE-CERTSM OR EDD WEB-CERTSM. Once payments are made on your extension it cannot be cancelled.
The EDD will respond to your request to advise you if you qualify to cancel your fourth federal extension and have it refiled effective May 13, 2012. If you qualify, the EDD will cancel your fourth federal extension with the effective date before May 13, 2012. During the week of May 13, 2012, the EDD will refiled your fourth federal extension with the effective date of May 13, 2012. When your extension if refiled, you will be mailed a new Notice of Fourth Federal Extension Filed (DE 6331EUZ-E) and Continue Claim forms. If you do not receive Continue Claim forms from the EDD by May 23, 2012, you will need to contact the EDD again.
If you do not qualify to cancel your fourth federal extension and have it refiled effective May 13, 2012, the EDD will respond to your request to cancel your claim explaining why you do not qualify to delay the filing of your fourth federal extension.




Best advice is that once tier 4 has started,DO NOT SUBMIT OR CLAIM ANY WEEKS! call or go online and cancel it and ask for it to be started at the later date.

you will need to exhaust tier 3 completely first.

I am still very curious how CA can have us starting tier 4 effective the 13th when we roll off EB on the 12th....does not conform to the
"one week after roll off" req.....
