Hi. I think I have Tier 3 and Tier 4 of federal extension benefits remaining on my original claim. My question is if I can start a new claim immediately after my federal extension has been fully exhausted?

My info/timeline:

Sept 2010: filed 1st UI claim
(Benefit Year Ends: 9/17/11)
Sept 2010-Oct 2011: collected benefits of $450/week
Nov 2011 & Dec 2011: worked temp job 1.
Jan 2012: filed 2nd UI claim. (BYE is Jan 2013??) Wages from 11/11 & 12/11 temp job meant a significantly lower weekly benefit amount, so b/c of the Deferred New Claim Program I went back to receiving $450/week from my 1st UI claim.
Jan 2012-Feb 17, 2012: collected benefits of $450/week
Feb 22, 2012-August 2012: work(ing) temp job 2 -- will end mid August.

Hypothetically:
Oct 2012: file 3rd UI claim. For this claim, the wages I earned from my highest earning quarter (April, May & June 2012) will amount to benefits of $300/week.

But with the Deferred New Claim Program (for which I believe I meet all 5 requirements: more than $100 less per week; original 1st claim expires after July 2010, etc.) -- will I revert back to receiving $450/week from Tier 3 and Tier 4 of federal extension benefits that I have remaining on my 1st claim?

Also, when can I start receiving benefits for the wages I earned from temp job 2? (worked Feb 22, 2012-Aug 2012).

If, hypothetically, I am able to receive the remainder of my fed extension benefits during Oct 2012-Jan 2013 from my 1st UI claim, beginning in Feb 2013 will I be able to receive state benefits of $300/week from my 3rd UI claim? And how does my 2nd UI claim filed in Jan 2012 affect anything?

Thanks for your help, anyone. Please let me know you need me to clarify anything.

The "one-year period" means one-year from the date of your 2nd claim (Jan 2012), which is the claim on which payments are being deferred under DNCP and can be resumed prior to that claim's bye.

Therefore, this is what will happen:

CA will put you back on DNCP in August until the end of the year, when all federal benefit payments end, or you've exhausted what remains of the EUC from Claim 1, whichever comes first.

If Congress extends the legislation in 2013 and you have not exhausted Claim 1 EUC, Claim 1 EUC will continue until your bye in January.

If you exhaust Claim 1 EUC before your Jan. bye, CA will then pay you state benefits from Claim 2 until that claim's bye in January. You will not exhaust state benefits from Claim 2. Whatever remains of Claim 2 benefits will be lost at the bye. State benefits are a "use it, or lose it" proposition. Your ability to exhaust them expires at the bye.

CA will then test your earnings for a new 3rd claim at your Jan. 2013 bye, at which point the Feb.-Aug 2012 earnings should create eligibility. That claim will not qualify for DNCP, so must be paid first.

If Congress extends UE legislation into 2013, you will be able to resume what is left of EUC on Claim 1 after you have exhausted state benefits from the 3rd claim. It remains to be seen in what form, however, the new UE extension will be enacted. It is possible you might lose some of your unexhausted EUC benefits.

Ariadne22, thank you so much! I can only send 1 DM per day so I posted my question on the forum in hopes that you would see it. Sorry to not have been clear about my 2nd claim and its BYE in my original question/DM to you. When my 2nd claim was deferred due to DNCP (after temp job 1), I forgot to consider that it was a separate claim in and of itself with a BYE of Jan 2013 (duh).

So in August when temp job 2 comes to an end and I file w/EDD, I will list my most recent employment in the past 18 months (temp job 2 and temp job 1), but I am still technically in the year of Claim 2 (BYE Jan 2013) -- and b/c of DNCP I will receive Claim 1 EUC till they expire in Dec 2012 or I exhaust them fully, whichever comes first.

Then in Jan 2013 with Claim 2's BYE, do I file again w/EDD in order to establish my 3rd claim (based on my Feb-Aug 2012 earnings)?? Or does that happen automatically?

Yes. Call EDD to reopen Claim 1.

YOU need to file a new claim in January, because you worked. If you had not worked, CA would automatically file the new claim for you. You can either file online, or call EDD.

I began EDD benefits on Jan 2011 with an expiration date of 1-12-2013. I haven't received a claim form since 12-11-2012. I am trying to figure out if I will have extended benefits for this year since the Federal Extension was passed for this year 2013. Can you please help me?

To qualify for EUC in California, you need base wages in excess of 40x your weekly benefit, or total base wages used to support the claim must be in excess of 1.5 high quarter wages. The base wages used for your claim are listed in your original monetary determination letter.

If you began EUC and CA hasn't sent you claim forms since December, it may be, if you had a small claim, all EUC attached to that claim, if it was eligible for EUC, is exhausted.

Need to know your original monetary determination. $$ amount. Did you work while collecting benefits and finally exhaust state benefits in December? Did you ever receive EUC?

CA will usually send you a notice if your claim doesn't qualify for EUC.
